HomeMy WebLinkAbout18560• 1 ORDINANCE NO. 18,560 C1 2 3 AN ORDINANCE TO AMEND THE 2001 BUDGET ORDINANCE TO 4 CREATE A SPECIAL PROJECT ACCOUNT FOR ADA CURB RAMP 5 CONSTRUCTION; TO AUTHORIZE THE TRANSFER OF FUNDS INTO 6 THE ACCOUNT; TO DECLARE AN EMERGENCY; AND FOR OTHER 7 PURPOSES. 8 9 WHEREAS, the 2001 City budget included an appropriation for the cost of curb ramp to construction to assure that the City is in compliance with the Americans with Disabilities Act 11 ( "ADA "), and to assure that the City remains in compliance with a federal consent decree to 12 assure the fulfillment of various obligations for past noncompliance with ADA, and 13 WHEREAS, in the past the City has attempted to contract for the construction of these 14 various curb ramp projects, but now has determined that such design, engineering, and 15 construction, can be handled by the Department of Public Works, and 16 WHEREAS, to assure an appropriate audit trail for the creation of this new special 17 fund to be handled within the City it is necessary formally to amend Little Rock, Ark., 18 Ordinance No. 18,409 (December 26, 2000), to authorize this transfer, 19 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 20 THE CITY OF LITTLE ROCK, ARKANSAS: 21 Section 1. Section 2 of Little Rock, Ark., Ordinance No. 18,409 (December 26, 2000) 22 is hereby amended to create a Special Project (Concrete Access Ramp) Fund in Account No. 23 210 - 220 -B213. 24 Section 2. The Board of Directors formally authorizes the transfer of two hundred 25 and fifty thousand dollars ($250,000) into Account No. 210 - 220 -B213 from Account No. 200 - 26 220 - 2210 - 2000 -6081 with the understanding that these funds shall be used for the design, [PAGE 1 OF 21 • • 1 engineering and construction of access curb ramps for the disabled in accordance with the 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 Americans with Disabilities Act. Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. Section 5. Repealer. All ordinances and resolutions, including by not limited to Little Rock, Ark., Ordinance No. 18,409 (December 26, 2000) ("the 2001 Budget ordinance "), are hereby repealed to the extent of such inconsistency. Section 6. Emergency. It is essential to the public health, safety and welfare that the City comply with federal laws such as the Americans with Disabilities Act, federal court orders such as the consent decree issued in 1999 that requires the City to comply with a program for curb ramp construction, and with various state and federal accounting laws, as well as appropriate governmental accounting practices; further, it is important that the City's ability to construct curb ramps not face any possible delay because a transfer of funds from one account to another within the City's budget process has not been fully finalized because a time requirement has not been met; an emergency is, therefore, declared to exist and this ordinance shall be in full force and effect from and after the date of its passage.
