3 AN ORDINANCE TO REPEAL LITTLE ROCK, ARK., ORDINANCE NO. 5939
4 (JULY 2, 1940), TO PAY COMMISSIONERS OF THE LITTLE ROCK WATER
5 WORKS COMMISSION; AND FOR OTHER PURPOSES.

7 WHEREAS, Little Rock, Ark., Ordinance No. 5939 (July 2, 1940), established the salaries to be
8 paid to Commissioners of the Little Rock Water Works Comrission ( "the Commission "), and
9 WHEREAS, as a result of the merger of commission into Central Arkansas Water pursuant to
10 an interlocal agreement with North Little Rock, Arkansas, there are no longer any Commission
11 revenues with which to pay this salary, and
12 WHEREAS, the sole reason that the Commission continues in existence is to assure the
13 appropriate disbursement of funds in a trust account of the Commission to be used for facilities
14 within the City of Little Rock, Arkansas, and
15 WHEREAS, this administrative responsibility no longer justifies a monthly salary for the
16 members of the Commission, and
17 WHEREAS, the Commission has asked that this ordinance be repealed,
18 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
19 OF LITTLE ROCK, ARKANSAS:
20 Section 1. Little Rock, Ark., Ordinance No. 5939 (July 2, 1940), is hereby repealed.
21 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause,
22 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such
23 declaration or adjudication shall not affect the remaining portions of the ordinance which shall
24 remain in full force and effect as if the portion so declared or adjudged to be invalid or
25 unconstitutional was not originally a part of the ordinance.
26 Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same that are
27 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such
28 inconsistency.
29 Section 4. Emergency Clause. The current ordinance that permits the payment of a salary to
30 members of the Little Rock Water Works Commission was written during a period of time when the

Commission had a revenue source with which to pay such salaries; however, since the merger of the Commission
into Central Arkansas Water, this revenue source is no longer available, and the remaining funds in the
Commission trust fund cannot be used to pay these salaries, hence, compliance with the current ordinance could
be considered in appropriate; it is, therefore, necessary to protect the public health, safety and welfare, and to
assure the proper accounting for all Commission revenues, to stop this practice by the repeal of this ordinance as
soon as possible; an emergency is, therefore, declared to exist and this ordinance will be in full force and effect
from and after the date of its passage.
