HomeMy WebLinkAbout18512I ORDINANCE NO. 189512 2 3 AN ORDINANCE TO RATIFY THE SPECIAL ELECTION 4 DATE OF AUGUST 149 2001, ESTABLISHED IN LITTLE 5 ROCK, ARK., ORDINANCE NO. 18,507 (JUNE 59 2001)9 FOR A 6 MILLAGE INCREASE TO BENEFIT THE CENTRAL 7 ARKANSAS LIBRARY SYSTEM; TO DECLARE AN 8 EMERGENCY; AND FOR OTHER PURPOSES. 9 10 WHEREAS, at the request of the Central Arkansas Library System (CALS) the Board of 11 Directors passed Little Rock, Ark., Ordinance No. 18,507 (June 5, 2001), which set August 14, 12 2001, as the dke of a special election on the question of whether to increase a property tax 13 millage to support CALS, and 14 WHEREAS, prior to the passage of this ordinance the Mayor received petitions which 15 contained the names of 398 persons who claimed to be qualified electors of the City, and the 16 initial review of these names confirmed that there were more than 100 names of qualified 17 electors on the petition, the number required by state law for the City to call for a special 18 election, and 19 WHEREAS, subsequent to the passage of this ordinance the City Clerk has completed a 20 formal review of the entire list of all 398 names and has accordingly confirmed that all persons 21 named therein are indeed qualified electors of the City of Little Rock, and 22 WHEREAS, the final verification of this review occurred after the June 5, 2001, date 23 that the initial ordinance was passed, and in an abundance of caution the City has decided to 24 ratify its prior action to call this election after there has been a final verification of the requisite 25 number of signatures to assure that there are at least 100 qualified voters who signed the 26 petitions, 27 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 28 THE CITY OF LITTLE ROCK, ARKANSAS: 29 Section 1. The Board ratifies in full the provisions of Little Rock, Ark., Ordinance 30 No. 18,507 (June 5, 2001), attached as Exhibit A to this ordinance, and further ratifies the call of (PAGE 1 OF 11 • • 1 a special election for August 14, 2001, on the question of increasing the tax on real and personal 2 property in the City of Little Rock, Arkansas, by one mill (1.0) from one and eight- tenths mills 3 (1.8) to two and eight - tenths mills (2.8) to be levied and collected for maintenance and operation 4 of the public libraries of the City. 5 Section 2. The Board ratifies in full the proposed ballot title set forth in Section 2 of 6 Little Rock, Ark., Ordinance No. 18,507 (June 5, 2001), as if that ballot title were set forth in this 7 ordinance word for word, the ratified ballot title to read in substantially the following form: 8 PROPOSED INCREASE OF LIBRARY TAX BY ONE (1.0) MILL FROM ONE AND 9 EIGHT TENTHS (1.8) MILLS ON ASSESSED VALUATION OR REAL AND 10 PERSONAL PROPERTY IN THE CITY OF LITTLE ROCK, ARKANSAS (Referred to 11 the people by the Board of Directors through the adoption of Little Rock, Ark., 12 Ordinance No. 18,507 (June 5, 2001). 13 14 ON THE QUESTION OF INCREASING THE LIBRARY TAX AUTHORIZED 15 PURSUANT TO AMENDMENTS 30 AND 72 TO THE ARKANSAS 16 CONSTITUTION FROM ONE AND EIGHT TENTHS (1.8) MILLS TO TWO AND 17 EIGHT TENTHS (2.8) MILLS ON REAL AND PERSONAL PROPERTY TO BE 18 USED FOR MAINTENANCE AND OPERATION OF THE PUBLIC CITY 19 LIBRARIES OPERATED BY THE CITY OF LITTLE ROCK AND THE CENTRAL 20 ARKANSAS LIBRARY SYSTEM. 21 FOR increase of tax on real and personal property to be used for maintenance and 22 operation of the public city libraries from one and eight tenths (1.8) mills to two 23 and eight tenths (2.8) mills ............................. ❑ 24 H 25 AGAINST increase of tax on real and personal property to be used for 26 maintenance and operation of the public city libraries from one and eight tenths 27 (1.8) mills to two and eight tenths (2.8) mills ............................. ❑ 28 Section 3. The results of the election shall be certified by the Election 29 Commissioners of Pulaski County, Arkansas, and proclaimed by the Mayor, and his 30 proclamation shall be published one time in a newspaper having general circulation within the [PAGE 2 OF 21 1 City of Little Rock, Arkansas, which proclamation shall be conclusive unless attacked in the 2 courts within thirty (30) days of the date of publication. 3 Section 4. The Mayor and the City Clerk, for and on behalf of the City of Little 4 Rock, Arkansas, are hereby directed to do all things necessary to call and hold the special 5 election authorized by this Ordinance, and to perform all acts necessary to carry out the intent of 6 this Ordinance. 7 Section 5. Severability. In the event any title, section, paragraph, item, sentence, 8 clause, phrase, or word of this ordinance is declared or adjudged to be invalid or 9 unconstitutional, such declaration or adjudication shall not affect the remaining portions of the to ordinance which shall remain in full force and effect as if the portion so declared or adjudged to 11 be invalid or unconstitutional was not originally a part of the ordinance. 12 Section 6. Repealer. All laws, ordinances, resolutions, or parts of the same that 13 are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such 14 inconsistency. is Section 7. Emergency Clause. The ability to have a properly operated and 16 available public library has already been deemed to be essential to promote the educational and 17 cultural development of the City, and is deemed to be essential to maintain the public health, 18 safety and welfare; the Board has already declared that its desire to have a properly operated 19 and available public library system is at risk in light of recent actions to diminish the amount of 20 funds made available by the State of Arkansas to local libraries, particularly at a time of rising 21 costs for the operation of these libraries; these prior declarations, because they occurred after a 22 preliminary examination to verify signatures on a petition to call a special election to increase 23 the library millage, but before a final certification that the requisite number of qualified electors 24 had signed the petitions, are still valid, but in an abundance of caution, the City wishes to 25 rearm its commitment to call this election 30 days prior to the election, to ratify its prior 26 actions, and to assure that no possible technical challenge can be made to the August 14, 2001, 27 election to increase this library millage; an emergency is, therefore, declared to exist and this 28 Ordinance shall be in f ll force and effect from and after the date of its passage. 29 PASSED: July 3, 2001 3o ATTEST: APPROVED: 31 [PACE 3 of 31 2 Nancy ood, ity Clerk Brad Cazort, Vice Mayor 3 APPROVED AS TO LEGAL FORM: 4 5 6 Thomas M.
