3 AN ORDINANCE TO CALL A SPECIAL ELECTION FOR
4 AUGUST 14, 2001, IN THE CITY OF LITTLE ROCK, ARKANSAS,
s ON THE QUESTION OF INCREASING THE TAX ON REAL
6 AND PERSONAL PROPERTY IN THE CITY OF LITTLE ROCK,
7 ARKANSAS, BY ONE MILL (1.0) FROM ONE AND EIGHT
8 TENTHS MILLS (1.8) TO TWO AND EIGHT TENTHS MILLS
9 (2.8) TO BE LEVIED AND COLLECTED FOR MAINTENANCE
10 AND OPERATION OF THE PUBLIC LIBRARIES OF THE CITY;
11 AND FOR OTHER PURPOSES.

13 WHEREAS, pursuant to Amendments 30 and 72 to the Arkansas Constitution,
14 100 or more taxpayers of the City of Little Rock, Arkansas, may file a petition with the
is Mayor and ask that the library tax upon real and personal property be levied and
16 collected for the maintenance and operation of the public city libraries and, may require
17 that the question be submitted to the electors, and
18 WHEREAS, such petitions have been submitted to the Mayor in proper form
19 with the required number of signatures, and

20 WHEREAS, it is desired that this special election be held on August 14, 2001, and
21 WHEREAS, this request for a one mill (1.0) increase in the real and personal
22 property tax to provide funds for the maintenance and operation of the public city
23 libraries has been required, in part, because of decreased state funding for such
24 libraries,

1 NOW, THEREFORE, IT BE ORDAINED BY THE BOARD OF DIRECTORS
2 OF THE CITY OF LITTLE ROCK, ARKANSAS:
3 Section 1. There is hereby called a special election to be held on August 14,
4 2001, at which election there will be submitted to the electors of the City of Little Rock,
5 Arkansas, the question of increasing the annual tax levied for the purpose of
6 maintaining and operating the Public City Libraries operated by the City of Little Rock,
7 Arkansas, and the Central Arkansas Library System, from one and eight tenths mills
8 (1.8) on the dollar of assessed valuation of all real and personal property subject to
9 taxation in the City of Little Rock, Arkansas, by one mill (1.0) to two and eight tenths
10 mills (2.8) on the dollar of assessed valuation of all real and personal property subject to
11 taxation in the City of Little Rock, Arkansas.
12 Section 2. The ballot title on the question of adoption of the Library Tax shall
13 be in substantially the following form:
14 PROPOSED INCREASE OF LIBRARY TAX BY ONE (1.0) MILL FROM ONE
15 AND EIGHT TENTHS (1.8) MILLS ON ASSESSED VALUATION OR REAL
16 AND PERSONAL PROPERTY IN THE CITY OF LITTLE ROCK, ARKANSAS
17 (Referred to the people by the Board of Directors through the adoption of Little
is Rock, Ark., Ordinance No. 18,507 (June 5, 2001).

20 ON THE QUESTION OF INCREASING THE LIBRARY TAX AUTHORIZED
21 PURSUANT TO AMENDMENTS 30 AND 72 TO THE ARKANSAS
22 CONSTITUTION FROM ONE AND EIGHT TENTHS (1.8) MILLS TO TWO
23 AND EIGHT TENTHS (2.8) MILLS ON REAL AND PERSONAL PROPERTY TO
24 BE USED FOR MAINTENANCE AND OPERATION OF THE PUBLIC CITY
25 LIBRARIES OPERATED BY THE CITY OF LITTLE ROCK AND THE CENTRAL
26 ARKANSAS LIBRARY SYSTEM.

8 Section 3. The results of the election shall be certified by the Election
9 Commissioners of Pulaski County, Arkansas, and proclaimed by the Mayor, and his
Io proclamation shall be published one time in a newspaper having general circulation
11 within the City of Little Rock, Arkansas, which proclamation shall be conclusive unless
12 attacked in the courts within thirty (30) days of the date of publication.
13 Section 4. The Mayor and the City Clerk, for and on behalf of the City of Little
14 Rock, Arkansas, are hereby directed to do all things necessary to call and hold the
15 special election authorized by this Ordinance, and to perform all acts necessary to carry
16 out the intent of this Ordinance.
17 Section 5. Severability. In the event any title, section, paragraph, item,
18 sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
19 or unconstitutional, such declaration or adjudication shall not affect the remaining
20 portions of the ordinance which shall remain in full force and effect as if the portion so
21 declared or adjudged to be invalid or unconstitutional was not originally a part of the
22 ordinance.
23 Section 6. Repealer. All laws, ordinances, resolutions, or parts of the same
24 that are inconsistent with the provisions of this ordinance are hereby repealed to the
25 extent of such inconsistency.

1 Section 7. Emergency Clause. The ability to have a properly operated and
2 available public library is essential to promote the educational and cultural development of the
3 City, and is deemed to be essential to maintain the public health, safety and welfare, this ability
4 is currently at risk in light of recent actions to diminish the amount of funds made available by
5 the State of Arkansas to local libraries, particularly at a time of rising costs for the operation of
6 these libraries; an emergency is, therefore, declared to exist and this Ordinance shall be in full
7 force and effect from and after the date of its passage.
