HomeMy WebLinkAbout184839 0 1 ORDINANCE NO. 18,483 7 3 AN ORDINANCE TO AMEND THE LITTLE 4 ROCK TRANSPORTATION CODE, CODIFIED AT 5 LITTLE ROCK, ARK., REV. CODE § 34-1 TO § 34- 6 97 (1988), TO DELETE REFERENCE TO MINI - 7 VANS REGARDING AIRPORT SHUTTLE 8 VEHICLES; DECLARING AN EMERGENCY; AND 9 FOR OTHER PURPOSES. 10 11 WHEREAS, On November 18, 1997, the City adopted a new Transportation 12 Code, codified at Little Rock, Ark., Rev. Code ( "LRC ") § 34-1 to § 34-97, that 13 governs transportation franchises of vehicles for hire, and 14 WHEREAS, the Transportation Code, LRC § 34-4, defines an airport shuttle 15 as "a motor vehicle with a seating capacity minimum of eight (8) and a maximum of 16 no more than fifteen (15) passengers, including the driver," and 17 WHEREAS, the airport shuttle definition in the Transportation Code also 18 indicates that "mini- vans" are acceptable for usage as an airport shuttle vehicle, and 19 AREAS, the term "mini -van" is not defined in the Transportation Code, 20 and, as such, the term "mini -van" has been the subject of multiple and conflicting 21 interpretation, and 22 AREAS, it has never been the intention of the Board of Directors in 23 enacting the Transportation Code to allow vehicles with a seating capacity of less 24 than eight (8) passengers to operate as an airport shuttle vehicle, and 25 WHEREAS, in order to clarify the definition of airport shuttle vehicle and to 26 avoid any further confusion regarding airport shuttle vehicles, the Board of Directors 27 finds it necessary to amend the Transportation Code Section 34-4 definition of 0 • 1 airport shuttle to delete reference to mini -vans and to emphasize that an airport 2 shuttle vehicle must have a seating capacity minimum of eight (8) passengers. 3 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 4 THE CITY OF LITTLE ROCK, ARKANSAS: 5 Section 1. LRC § 344, Definitions — Airport shuttle, shall be amended to 6 read as follows: 7 Airport shuttle vehicle shall mean a motor vehicle with a seating 8 capacity minimum of eight (8) and a maximum of no more than 9 fifteen (15) passengers, including the driver. Sedans shall be 10 excluded for usage as an airport shuttle vehicle. The vehicle shall 11 prominently display "Shuttle Service" on the front or rear sides 12 of the vehicle. This marking may be permanent or temporary. 13 Section 3. Repealer. All ordinances, resolutions, laws or policies, or parts of 14 any such material, in conflict with the provisions of this ordinance are hereby 15 repealed to the extent of such inconsistency. 16 Section 4. Severability. In the event any section, subsection, subdivision, 17 paragraph, subparagraph, item, sentence, clause, phrase, or word of this ordinance is 18 declared or adjudged to be invalid or unconstitutional, such declaration or 19 adjudication shall not affect the remaining provisions of this ordinance, as if such 20 invalid or unconstitutional provision was not originally a part of this ordinance. 21 Section 5. Emergency Clause. Since the City's Transportation Code was 22 intended to be a comprehensive codification of ordinances dealing with for -hire 23 transportation within the City of Little Rock, Arkansas, and such regulation is 24 essential to protect the public health, safety and welfare, an emergency is declared to 25 exist and this ordinance shall be in full force and effect from and after the date of this 26 adoption. 27 PASSED: May 15, 2001 28 29 1 ATTEST: 2 4 5 Nancy V%00 t Caey Cierk 6 7 APPROVED AS TO LEGAL FORM: 8 9 10�^ 11 Thomas M.
