HomeMy WebLinkAbout18443AN ORDINANCE TO ACCEPT THE VOLUNTARY ANNEXATION OF 27.5 ACRES TO THE CITY OF LITTLE ROCK, ARKANSAS, MAKING SAPS A PART OF THE CITY OF LITTLE ROCK, ARKANSAS; TO DECLARE AN EMERGENCY; AND FOR OTHER PURPOSES. AREAS, a Petition was filed with the County Clerk of Pulaski County, Arkansas by the owner of the hereinafter described lands praying that said lands be annexed to and be made a part of the City of Little Rock, Arkansas, and, WHEREAS, on January 4,2001 an Order Approving Annexation and on January 11, 2001 an Amended Order Approving Annexation were entered by the County Court of Pulaski County, Arkansas, wherein the Pulaski County Judge found that the Petition was signed by a majority of the total number of real property owners in said area proposed to be annexed and by the owners of more than one -half of the acreage of said area; that said lands are contiguous and adjoining the present corporate limits of the City of Little Rock, Arkansas; that an accurate map of said lands had been filed with and made a part of said Petition; that proper notice had been given for the time and in the manner prescribed by law; and that said lands should be annexed to and made a part of the City of Little Rock, Arkansas, subject to acceptance of same by the Board of Directors of said City at the proper time as prescribed by law; and, AREAS, the time fixed by law for, appealing from said Order Approving Annexation and Amended Order Approving Annexation made by the Pulaski County Court has expired and no appeal has been taken from said Orders. Sectfion 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in frill force and effect as if the portion so declared to be adjudged invalid or unconstitutional was not originally a part of the ordinance. Seaton 3. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repeated to the extent of such inconsistency. 2 0 U Section 4. Emergency. The land that is to be annexed pursuant to this ordinance has already been granted a conditional use permit pursuant to the City's zoning and planning jurisdiction, but until the property is fully within the corporate limits of the City, there is a question as to the extent and means by which the City can enforce this special permit; the ability to enforce the terms of a conditional use permit is essential to the public health, safety, and welfare, since it is an integral part of the City's zoning ordinances, and since the whole purpose of zorung is to assure a quality existence for citizens and development within the City, an emergency is, therefore, declared to exist and this ordinance shall be in full farce and effect from and after the date of its passage. Based upon the Petition, the statements of counsel and from the other matters and things adduced by the Court, the Court finds that its Order Approving Annexation should be amended as follows: 1. The Court entered its Order Approving Annexation on January 4, 2001 in this matter. Subsequent to the entry of said Order, Petitioner discovered that a small parcel of property located between the annexed property and State Highway 10 which was previously acquired by the Arkansas State Highway Commission was abandoned by the Arkansas State Highway Commission pursuant to Minute Order entered on March 7, 1993 and filed of record in the real estate records of Pulaski County, Arkansas in Book 93 at Page 164. 2. This parcel was included in the description of the property shown on the map attached as Exhibit `B" to Petitioner's Petition For Annexation but was not included in the legal description of the property. 3. The Court finds that to accurately depict the property Petitioner seeks to annex into the City of Little Rock, the legal description of the annexed property should be amended to include the parcel of property abandoned by the Arkansas State Highway Commission and that the revised legal description set forth below shall henceforth describe the annexed property.
