HomeMy WebLinkAbout184420 0 ORDINANCE NO. 18,442 AN ORDINANCE RECLASSIFYING PROPERTY LOCATED IN THE CITY OF LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS, SECTION 1. That the zone classification of the . following property be and is hereby changed as indicated: Z -6969 - Described as parts of Tracts 39 and 41, Graceland Acres Annex Subdivision and part of Lots B and C, Terral's Replat of Tract 40, Graceland Acres Annex Subdivision, Little Rock, Arkansas, more particularly described as: Commencing at the NW corner of said Tract 39; thence S87 °05'20" East along the North line of said Tract 39 23.71 feet to the point of beginning; thence continue along the North line of said Tract 39 S87 °05120" East 96.29 feet; thence S24'27 "O1" West 162.07 feet; thence S24 025125" West 161.34 feet; thence S38 °45117" West 146.01 feet; thence N04 °51114" East 117.25 feet; thence N21 °53118" East 160.18 feet; thence N21 °56106" East 158.64 feet to the point of beginning, containing 35,520 square feet or 0.815 acres, more or less m!!7 Part of Tract 42, Graceland Acres Annex Subdivision, Little Rock, Arkansas, more particularly described as: Commencing at the SW corner of said Tract 42; thence S87 °11'12" East along the South line of said Tract 42 132.26 feet to the point of beginning; thence N54 °28120" East 223.18 feet; thence S02 °48148" West 138.45 feet to a point on the South line of said Tract 42; thence 0 0 S87 011'12" West along the South line of said Tract 42 175.05 feet to the point of beginning, containing 12,118 square feet or 0.278 acres, more or less: From "R -2" Single Family to "C -4" Open Display Commercial District. (6700 S. University Avenue) SECTION 2. That the zoning of the property described in Section 1 of this ordinance shall be subject to the following conditions which were proposed by the applicant and which shall be covenants running with the land to bind subsequent grantees of the property: o The use of loudspeakers after hours shall be curtailed. • A professional lawn care service shall be hired and retained to maintain the property, including the cleaning up of limbs and trash on the Mabelvale Pike side of the west fence line. • The buffer and landscaping adjacent to the residential area along Mabelvale Pike shall be maintained. • The rear thirty (30) feet of the automobile sales lot shall be utilized for vehicle storage only. • On -site lighting shall not be expanded and existing on -site lighting shall be aimed downward as much as possible so as not to impact nearby residents negatively. • The gate accessing the site from Mabelvale Pike shall be kept closed and used only as an emergency access point. • The basketball goal shall not be replaced on the Mabelvale Pike Perimeter and the R -2 zoned area located between Mabelvale Pike and the automobile sales lot shall not be used in any manner other than as a natural barrier. SECTION 3. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Sections 1 and 2 hereof. SECTION 4. That the Ordinance shall take effect and be in full force 30 days after the date of its passage and approval. 2 0 0 SECTION 5. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared to adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 6. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this resolution are hereby repealed to the extent of such inconsistency.
