HomeMy WebLinkAbout184332002173310 09 /e3 12002 e14 AN Filed 8 Recorded d in Official Records of CAROLYN STRLEY PULASKI COUNTY ORDIANCE # 18,433 CIRCUITCOUNTY CLERK Fees 1233.00 AN ORDINANCE DISSOLVING SEWER IMPROVEMENT DISTRICT NO. 144 OF LITTLE ROCK, ARKANSAS; AND PRESCRIBING OTHER MATTERS PERTAINING THERETO WHEREAS, Ordinance # 13205 of the city of Little Rock, Arkansas (the city) passed an approved on the 5 day of October, 1978 established Sewer Improvement District #144 of Little Rock, Arkansas (the "District "). WHEREAS, the District was formed for the purpose of constructing a sewer system to connect with the municipal sewer system of the city (the "improvements'); and WHEREAS, the improvements have been completed and are owned and operated by the city as part of the municipal sewer system; and WHEREAS, the bonds and other obligations of the District, including the District's Improvement Bonds, have been paid in full and surplus funds have been distributed to by the district to the property owners, and WHEREAS, Ordinance No. 13511 of the City, passed and adopted the 3r° day of October, 1978 levied a tax on the assessment of benefits of the district (the "Tax "); and WHEREAS, the Commissioners of the district have requested that the district be dissolved; NOW, THEREFORE, BE IT ORDAINED by the Board of Directors, the City of Little Rock, Arkansas: Section 9 is hereby dissolved. Section 2. Section 3. That Sewer Improvement District No. 144 of Little Rock, Arkansas That the tax shall no longer be extended for collection. That the Commissioners are hereby relieved from further duties. Section 5. That Ordinance No. 13205 and Ordinance No. 13511 are hereby repealed. All other ordinances and parts thereof in conflict herewith are hereby repealed to the extent of such conflict. OF COUNSEL Cy Carney City Manager of Little Rock 500 West Markham, Room 203 Little Rock, AR 72201 Re: Dissolution of Sewer Improvement District #144 of Little Rock, AR Dear Mr. Carney: I am writing this letter to answer any questions that the Board of Directors may have in the Dissolution of Sewer Improvement District #144. All bonds in Sewer Improvement District #144 have been retired. See attachment of letter from Trust Department, Simmons First Bank of El Dorado, AR. All refunds to property owners of Sewer Improvement District #144 have been completed. All refunds under the Sewer Improvement District law of the State of Arkansas are made pro -rata to each property owner on the basis of the amount of Improvement District Tax they paid each year. No refunds are made to property owners who have delinquent Sewer Improvement District Taxes. Refund checks were mailed to property owners in July of 1999. When a substantial number of checks were not cashed the Assessor of the District checked to determine the problem and discovered that the County had given us the addresses of property owners for previous years rather than the current year. 0 0 After the time had passed so that the checks not cashed were invalid, the Assessor then secured the current addresses of property owners who had not cashed the checks. Then the Assessor reissued those checks to property owners in May of 2000. With the second mailing of refunds to property owners who had not cashed a check the refunds were completed. Sewer Improvement District #144 has refunded a total of $23,883.00 to property owners. We respectfully request that the Board of Directors approve the Ordinance of Dissolving said District and releasing said Improvement District Commissioners from their responsibilities.
