CODE § 34 -38 (1988) 6 TO INCLUDE SUCH REGULATION; TO DECLARE AN 7 EMERGENCY; AND FOR OTHER PURPOSES. 8 9 WHEREAS, the Little Rock Transportation Code permits the Board of Directors 10 of the City of Little Rock, Arkansas, to grant taxicab operator permits to an appropriate 11 applicant, and 12 WHEREAS, since April 1, 1983, only two operators of multiple taxi cabs have 13 been permitted within the City, but in recent years one of these operators has used two 14 business names, and the second operator now seeks permission to use two business 1s names, thus giving the impression that there are actually four taxi cab operators 16 authorized to operate on City streets (in addition to one independent taxi cab operator), 17 and IS WHEREAS, the Code is not clear as to whether a taxicab operator may use 19 multiple business names pursuant to one permit, and the Board believes that such a 20 practice is confusing to public and may hinder the ability of citizens and patrons of taxi 21 cabs within the City to seek appropriate redress, file complaints, or provide positive 22 feedback if appropriate safeguards are not in place, 23 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF 24 DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: 25 Section 1. Little Rock, Ark. Rev. Code § 34 -38 (c) (1988), is hereby amended 26 to add subsection (12) which reads as follows: 27 (12) Operation under one business name. Only one business name 28 and color scheme shall be used for any cab operating [1] 0 0 I pursuant to a fleet taxi cab operator permit, regardless of the 2 number of vehicles listed and authorized under the permit, 3 without the express written authorization of the 4 Administrator. s Section 2. The Administrator shall provide written authorization for a fleet taxi 6 cab operator to use an additional business name and color scheme, from the primary 7 name listed on the application for permits, if the operator provides proof that all s personnel, drivers, and persons working with the business listed in the taxi cab operator v permit have available to them forms that shall be immediately provided to any person to who requests information about the company, and which set forth: tr (A) The name of the company; 12 (B) The name and address of the agent for service of process, or 13 if there is no agent for service of process, the name and 14 address of the person(s) authorized to accept service of 15 process for the company; 16 (C) The address, telephone number, telefacsimile number and, if 17 available the email address of the company; and is (D) The name of the person(s), to whom a complaint, allegation 19 of loss or injury, or statement of commendation, can be 20 directed. 21 Section 3. Severability. In the event any title, section, subsection, subdivision, 22 paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or 23 adjudged to be invalid or unconstitutional, such declaration or adjudication shall not 24 affect the remaining portions of the ordinance which shall remain in full force and effect 25 as if the portion so declared or adjudged invalid or unconstitutional was not originally 26 a part of the ordinance. 121 1 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that 2 are inconsistent with the provisions of this resolution are hereby repealed to the extent 3 of such inconsistency. 4 Section 5. Emergency. It is important that citizens and patrons of taxi cabs authorized s and permitted to do business within the corporate limits of the City have the ability to know exactly 6 who to contact with complaints or commendations, and if necessary who to sue in the event there 7 any personal or property damage occurs which is alleged to the be responsibility of the taxi cab 8 operator, the taxi driver, or any other person or entity associated with the taxi cab company; such 9 information is essential to protect the public health, safety and welfare, but at present is not readily 10 available because one taxi cab operator utilizes two business names for taxis operating pursuant to 11 a City permit, and a second taxi cab operator has requested the ability to so operate; an emergency 12 is, therefore, declared to exist and this ordinance shall be in full force and effect from and after the 13 date of its passage. 14 PASSED: December 19, 2000 1s ATTEST: APPROVED: 16 17 Nc� �le 18 N y W d, City ity Clerk Ji$ Dailey, Mayor 19 20 APPROVED AS TO LEGAL FORM: 21 23 Thomas M.
