3 AN ORDINANCE TO AUTHORIZE THE CITY
4 MANAGER TO ENTER INTO AN AGREEMENT
5 WITH NETWORK ASSOCIATES TO PROVIDE
6 UPDATES AND TECHNICAL SUPPORT FOR
7 COMPUTER VIRUS SOFTWARE; TO DISPENSE
8 WITH COMPETITIVE BIDDING; TO DECLARE AN
9 EMERGENCY; AND FOR OTHER PURPOSES.

11 WHEREAS, after a competitive bid process the City selected Network Associates
12 to provide the original technical support for the City's computer virus software, and
13 WHEREAS, it would be impractical and unfeasible to bid for a new provider of
14 such support at this time,
15 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
16 THE CITY OF LITTLE ROCK, ARKANSAS:
17 Section 1. The City Manager is authorized to enter into a two year agreement with
18 Network Associates in an amount not to exceed eighteen thousand five hundred dollars
19 ($18,500) to provide technical support for the City's computer virus software.
20 Section 2. The fact that Network Associates won the competitive bid for the original
21 computer virus software package, and that this package is still in operation, and that it would
22 be costly to rebid the entire package at this time, makes it impractical and unfeasible to bid for
23 these particular services; therefore, the Board dispenses with the requirement of competitive
24 bidding
25 Section 3. Severability. In the event any title section, subsection, subdivision,
26 paragraph, subparagraph, item, sentence, clause, phrase, or word of this ordinance is declared
27 or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect
28 the remaining portions of the ordinance which shall remain in full force and effect as if the
29 portion so declared or adjudged invalid or unconstitutional was not originally a part of the
30 ordinance.

1 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are
2 inconsistent with the provisions of this resolution are hereby repealed to the extent of such
3 inconsistency.
4 Section 5. Emergency. The ability to protect the City's various computer systems from
5 attack by viruses is essential to public health, safety and welfare; it is essential to have a
6 technical support contract in place to assure the maximum ability to protect the City system
7 from viruses; an emergency is, therefore, declared to exist and this ordinance shall be in full
8 force and effect from and after the date of its passage.
