3 AN ORDINANCE TO DECLARE THE EVALUATION
4 OF THE CITY'S ANIMAL CONTROL SERVICES A
5 PROFESSIONAL SERVICE; AND FOR OTHER
6 PURPOSES.

8 WHEREAS, the City has been involved in a process to reevaluate the manner
9 in which it operates the animal services division and to redraft the ordinance that
10 outlines the City's requirements for the care and maintenance of animals and pets
11 within the City, and
12 WHEREAS, a professional evaluation of various aspects of the City's efforts
13 with the animal services division and its ordinance would be of help to the City, and
14 WHEREAS, the selection of the entity to conduct this violation should be
15 based upon a finding that it is most qualified to perform the task, but that without
16 an amendment to the City's purchasing procedures, the selection would have to be
17 based upon the lowest price,
18 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
19 THE CITY OF LITTLE ROCK, ARKANSAS:
20 Section 1. The Board of Directors declares the evaluation of its animal service
21 division, ordinance and policies, a professional service because cost or price bidding would
22 not be in the best interests of the City.
23 Section 2. This declaration is made pursuant to Little Rock Rev. Code § 2-
24 243(a)(3) (1988) and will be deemed a professional service only for the purposes of an
25 evaluation to occur in 2000 or 2001; further, this declaration of a professional service will
26 not be a service listed in subsections (1) or (2) of Little Rock, Ark., Rev. Code § 2- 243(a).
27 Section 3. Severability. In the event any title, section, subsection, item, sentence,
28 clause, phrase, or word of this ordinance is declared or adjudged to be invalid or
29 unconstitutional, such declaration or adjudication shall not affect the remaining portions

of the ordinance which shall remain in full force and effect as if the portion so declared or
adjudged invalid or unconstitutional was not originally a part of the ordinance.
Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that
are inconsistent with the provisions of this resolution are hereby repealed to the extent of
such inconsistency.
