3 AN ORDINANCE TO AUTHORIZE A CONTRACT WITH
4 J.A. RIGGS FOR REPAIRS ON THE LANDFILL
5 COMPACTOR; TO DECLARE IT IMPRACTICAL AND
6 UNFEASIBLE TO BID THIS CONTRACT; TO DECLARE
7 AN EMERGENCY; AND FOR OTHER PURPOSES.

9 WHEREAS, after a competitive bidding process, the City purchased a compactor from
10 J. A. Riggs, a Caterpillar dealer, and
11 WHEREAS, this unit is now in need of repairs to the transmission, articulated yoke, and
12 brake system, and these repairs will require Caterpillar parts, and
13 WHEREAS, the total amount of these repairs would normally necessitate a formal
14 bidding process, but the need to act quickly, the need to purchase Caterpillar parts, and the
15 familiarity of the mechanics at J.A. Riggs makes it impractical and unfeasible to bid these
16 particular repairs, particularly in light of the need to get this work done quickly,
17 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
18 THE CITY OF LITTLE ROCK, ARKANSAS:
19 Section 1. The City Manager is authorized to enter into an agreement, not to exceed
20 $34,625.75, with J.A. Riggs for repairs to the transmission, articulated yoke, and brake system
21 for the landfill compactor.
22 Section 2. Because of the need to use Caterpillar parts for these repairs, the fact that
23 J.A. Riggs mechanics have worked on this particular unit in the past, and the fact that these
24 repairs need to be completed as quickly as possible in order for the City to maintain its
25 operations at the landfill, the Board of Directors finds that it is impractical and unfeasible to
26 issue competitive bids for these repairs and, therefore, waives such bidding in this case.
27 Section 3. Funds for these repairs are available in Account No. 603 - 220 - 2120 -6081.
28 Section 4. Severability. In the event any section, subsection, subdivision, paragraph,
29 subparagraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged
30 to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining

1 portions of the ordinance which shall remain in full force and effect as if the portion so declared
2 or adjudged invalid or unconstitutional was not originally a part of the ordinance.
3 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same, that are
4 inconsistent with the provisions of this resolution are hereby repealed to the extent of such
5 inconsistency.
6 Section 6. Emergency. The ability to maintain efficient operations at the City's landfill
7 is essential to maintain the public health, safety and welfare, and these operations cannot be
8 maintained as necessary until the landfill compactor referred to in this ordinance is repaired;
9 and emergency is, therefore, declared to exist and this ordinance shall be in full force and effect
10 from and after the date of its passage.
