HomeMy WebLinkAbout182572 ORDINANCE NO. 18,257 3 4 AN ORDINANCE GRANTING A FRANCHISE TO THE 5 ARKANSAS TEACHER RETIREMENT SYSTEM FOR 6 AIR RIGHTS ABOVE WEST SIXTH STREET FOR A 7 PEDESTRIAN SKYBRIDGE CONNECTING A PARKING a DECK WITH THE VICTORY BUILDING AT THE 9 CORNER OF CAPITOL AND VICTORY STREETS; FOR 10 THE PURPOSE OF CONSTRUCTION, ERECTION, 11 MAINTENANCE, OPERATION AND REPAIR OF AN 12 ENCLOSED SKYBRIDGE OVER WEST SIXTH STREET. 13 14 WHEREAS, the Little Rock Board of Directors has been asked to grant a Franchise 15 to the Arkansas Teacher Retirement System to use the air space above West Sixth Street in 16 order to construct and maintain an enclosed skybridge over West Sixth Street in the city; and 17 WHEREAS, the skybridge is intended to connect a proposed 1000 car parking deck 18 at Sixth and Victory Streets with the proposed Victory Building at the corner of Capitol and 19 Victory Streets; and 20 WHEREAS, the Little Rock Board of Directors desires to grant the Franchise to the 21 Arkansas Teacher Retirement System for so long as the skybridge exists and as long as the 22 grantee of the Franchise shall construct, operate, and maintain the structure in compliance 23 with City codes and ordinances. 24 NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS 25 OF THE CITY OF LITTLE ROCK, ARKANSAS: 26 SECTION 1. The Little Rock Board of Directors approves and grants a Franchise 27 to the Arkansas Teacher Retirement System, and to its successors and assigns in perpetuity, 28 to use a portion of airspace above West Sixth Street in Little Rock, Arkansas. 29 SECTION 2. The Franchise is granted for the purpose of the construction, operation, 30 maintenance and repair of an enclosed skybridge connecting a parking deck on Block 330, 31 Original City of Little Rock Addition, with an office building to be constructed on Block 32 331, Original City of Little Rock Addition (collectively, the "Property"). 33 SECTION 3. The enclosed skybridge will be approximately twenty (20) feet in 1 I width, sixteen (16) feet inoght and eighty (80) feet long, tota*5,980 cubic feet of heated 2 space and 8,305 cubic feet of outside area of the skybridge, which lowest elevation shall not -e; 3 be less than nineteen feet and eight inches (19'8") above the highest grade of the street. This 4 Franchise shall include the right to construct and maintain four (4) architectural support 5 columns, two on the north side and two on the south side of West Sixth Street, provided such 6 columns do not obstruct pedestrian access on the sidewalks. 7 SECTION 4. The structure permitted by this Franchise shall be constructed, operated, 8 and maintained in compliance with City codes and ordinances for the life of the Franchise. 9 SECTION 5.
