3 AN ORDINANCE TO AMEND CHAPTER 31 OF THE LITTLE
4 ROCK REVISED CODE OF ORDINANCES TO PROVIDE FOR
5 A WAIVER OF MASTER STREET PLAN IMPROVEMENTS FOR
6 CERTAIN IMPROVEMENTS FOR O'REILLY AUTO PARTS
7 STORE LOCATED ON THE NORTHEAST CORNER OF ASHER
8 AVENUE AND FAIR PARK BOULEVARD; AND FOR OTHER
9 PURPOSES.

11 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
12 CITY OF LITTLE ROCK, ARKANSAS:
13 Section 1. Chapter 31 of the Little Rock Revised Code of Ordinances is hereby amended
14 to provide for a waiver for O'Reilly Auto Parts of certain requirements within the Subdivision Ordinance
15 and the Master Street Plan for the City of Little Rock, Arkansas, as follows:
16 (a) Chapter 31 -201 requirements of the Master Street Plan for
17 boundary street improvements shall be waived for the building permit
18 issued to construct a new auto parts store on the northeast comer of
19 Asher and Fair Park Boulevard. This specific waiver, limited to this
20 initial building permit, is of the requirement to construct a wider right
21 turn lane on Asher Avenue, and to construct or widen the lane on Brack
22 Street. Sidewalk construction is still required.
23 Section 2. Severability. In the event any section, subsection, subdivision, paragraph,
24 subparagraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be
25 invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of
26 the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid
27 or unconstitutional was not originally a part of the ordinance.
28 Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are
29 inconsistent with the provisions of this resolution are hereby repealed to the extent of such inconsistency.
