ORDINANCE NO. 18,230
AN ORDINANCE APPOINTING NEW COMMISSIONERS TO SEWER
IMPROVEMENT DISTRICT NO. 147 OF LITTLE ROCK, ARKANSAS
WHEREAS, pursuant to Ordinance No. 15,241 of the City of Little Rock, Arkansas, passed
February 3, 1987, Sewer Improvement District No. 147 of Little Rock, Arkansas was established;
and
WHEREAS, on September 4, 1991, Issac Green was appointed as a commissioner of the
District and filed his oath of office with the City on September 5, 1991; and
WHEREAS, on September 5, 1991, Ervin L. Freeman was appointed as a commissioner of
the District and filed his oath of office with the City on September 5, 1991; and
WHEREAS, on December 30, 1998, Helen Ashley was appointed as a commissioner of the
District and filed her oath of office with the City on January 14, 1999; and
WHEREAS, Issac Green passed away in 1999 and a petition signed by five property owners
has been filed with the City pursuant to Arkansas Code Annotated § 14 -88 -304, and the petition
requests that Shirley A. Warner be named as commissioner to replace Mr. Green; and
WHEREAS, Mr. Freeman and Ms. Ashley wish to resign as commissioners of Sewer
Improvement District No. 147 of Little Rock, Arkansas; and
WHEREAS, William O. Greene and Dr. Guy Forrest Gardner have volunteered to serve as
commissioners of the District; and
WHEREAS, Mr. Green is employed with OrthoArkansas, P.A, 10301 Kanis Road, Little
Rock, Arkansas, and Dr. Gardner is employed with Arkansas Otolaryngology, Inc., 10201 Kanis
Road, Little Rock, Arkansas, both of which are property owners in the District;
NOW, THEREFORE BE IT ORDAINED by the Board of Directors of the City of Little
Rock, Arkansas:
Section 1. That Shirley A. Warner is a property owner within the District and is appointed
by replace Isaac Green.
Section 2. That William 0. Greene and Dr. Guy Forrest Gardner are owners of real property
within the District and are hereby appointed to replace Ervin Freeman and Helen Ashley as District
commissioners.
Section 3. There is hereby declared to be an existing emergency and that there is an
immediate need for the appointment of commissioners in this sewer improvement district to promote
and protect the health, safety and welfare of the citizens of Little Rock, Arkansas and this ordinance
shall be in full force and effect from and after its passage.
