ORDINANCE NO. 18,094
AN ORDINANCE TO AUTHORIZE THE ENGAGEMENT
OF SHULTS & RAY TO PROVIDE LEGAL SERVICES TO
THE CITY; TO DISPENSE WITH COMPETITIVE
SELECTION; TO DECLARE AN EMERGENCY; AND FOR
OTHER PURPOSES.
WHEREAS, the City is engaged in litigation with M. S. Green -- Little Rock and the
10 Little Rock Advertising & Promotion Commission concerning, among other things, the
u concession rights at the new Statehouse Convention Center, and previously retained H.
12 William Allen to provide legal counsel in this matter, but it has become apparent that there is
13 a need for additional legal services, and
14 WHEREAS, it is not feasible to competitively select a new law film particularly in light
15 of the fact that hearings and depositions have already been set,
16 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
17 THE CITY OF LITTLE ROCK, ARKANSAS:
1s Section 1. The City Manager is authorized to enter into a legal services agreement
19 with Shults & Ray to provide legal services to the City in litigation concerning M.S. Green --
2o Little Rock and the Little Rock Advertising & Promotion Commission.
21 Section 2. Because hearings have been set and depositions have been scheduled, the
22 Board finds that it is impractical and infeasible to competitively select a law firm to provide
23 these services.
24 Section 3. Emergency. The ability to properly defend the concessions contract and
25 other matters concerning the Excelsior Hotel, the major convention center hotel adjacent to
26 the Statehouse Convention Center, and its new expansion, is essential to the public health,
27 safety and welfare. An emergency is therefore declared to exist and this ordinance shall be in
28 full force and effect from and after the date of its passage.
