AN ORDINANCE DISPENSING WITH COMPETITIVE
BIDDING AND AUTHORIZING THE CITY MANAGER TO
ENTER INTO A SOLE SOURCE CONTRACT WITH THE
LITTLE ROCK SCHOOL DISTRICT IN THE AMOUNT OF
$32,332 FOR THE LITTLE ROCK SCHOOL DISTRICT
MIDDLE SCHOOL PROFESSIONAL DEVELOPMENT
PROGRAM; DECLARING AN EMERGENCY; AND FOR
OTHER PURPOSES.
WHEREAS, the Little Rock School District junior high schools will become
middle schools in the fall of 1999; and
WHEREAS, grades 6, 7 and 8 will become middle school grades, while
ninth grade students will move to the high school level; and
WHEREAS, as recommended in the nationally recognized Carnegie
Foundation report on adolescents, Turning Points, teachers of middle school
students should have specific expertise relative to teaching and understanding
adolescents; and
WHEREAS, the Little Rock School District Middle School Professional
Development Program is a pilot program that commits to a professional
development program specifically designed for middle level teachers and
administrators; and
WHEREAS, Approximately 450 teachers and administrators will be involved
in the professional development experiences in preparation for the middle school
transition; and
WHEREAS, the City is committed to support programs that promote
quality educational experiences for youth; and
WHEREAS, the Middle School Professional Development Program is in
congruence with the goals of the Little Rock Education Commission; and
WHEREAS, the City of Little Rock may dispense with the requirement
of competitive bidding in exceptional situations where such procedure is not
feasible and impractical; and

1 WHEREAS, the unique nature and location of this program make City
2 contribution to the funding of the Little Rock School District Middle School
3 Professional Development Program appropriate for sole source funding of
4 Education Commission monies; and
5 WHEREAS, due to the unique nature and location of this project, on May
6 13, 1999 the Little Rock Education Commission determined that it was
7 impractical and unfeasible to competitively bid in this instance and voted to
8 recommend a sole source contract to the City Board of Directors; and
9 WHEREAS, the City Board of Directors desires to enter into a sole source
10 contract with the Little Rock School District to provide $32,332 for funding of
I 1 the Little Rock School District Middle School Professional Development Program.
12 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
13 DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:
14 SECTION 1. Due to the unique nature and location of the Middle School
15 Professional Development Program, it is impractical and unfeasible to
16 competitively bid in this instance.
17 SECTION 2. The City Manager is authorized to dispense with competitive
18 bidding and enter into a sole source contract with the Little Rock School District
19 in the amount of $32,332 for the Little Rock School District Middle School
20 Professional Development Program.
21 SECTION 3. Severability. In the event any section, subsection, subdivision,
22 paragraph, subparagraph, item, sentence, clause, phrase, or word of this ordinance
23 is declared or adjudged to be invalid or unconstitutional, such declaration or
24 adjudication shall not affect the remaining portions of this ordinance which shall
25 remain in full force and effect as if the portion so declared or adjudged invalid or
26 unconstitutional was not originally a part of this ordinance.
27 SECTION 4. Emergency. It is hereby found and determined by the Board of
28 Directors of the City of Little Rock that time is of the essence to complete the
29 services required under this contract. Therefore, an emergency is hereby declared
30 to exist, and this Ordinance, being necessary for the preservation of the public
31 peace, health and safety, shall be in full force and effect immediately upon passage
32 and approval by the Board of Directors.
