AN ORDINANCE TO AMEND LITTLE ROCK, ARK. REV. CODE
§ 18 -52(c) (1988) TO PERMIT CONSTRUCTION IN DISASTER
AREAS FOR EXTENDED HOURS; TO DECLARE AN
EMERGENCY; AND FOR OTHER PURPOSES.
8 WHEREAS, the current noise ordinance prohibits construction noises before the hour of 7:00
9 a.m. and after the hour of 6:00 p.m.; and
10 WHEREAS, the exception for emergency situations does not deal with construction
11 necessary as a result of natural disasters like the January 21, 1999, tornado, and
12 WHEREAS, during construction periods in disaster areas recognized as such by resolution
13 of the Board of Directors the hours of construction that are permitted should be extended from 6:00
14 a.m. to 8:00 p,m.
15 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
16 THE CITY OF LITTLE ROCK, ARKANSAS:
17 Section 1. Little Rock, Ark., Rev. Code § 18 -52 is hereby amended to add the following
18 subsection
19 (c)(5) Construction work between the hours of 6:00 a.m. and 8:00 p.m. on
20 weekdays and Saturdays in areas declared by resolution of the Board of
21 Directors to be disaster areas. For purposes of this subsection, construction
22 work means the erection, including excavation, demolition, alteration or repair
23 of any building in a residential district. Any resolution to declare an area a
24 disaster area shall include a map of the area and a time period during which
25 such designation shall be effective.

26 Section 2. Severability. In the event any title, section, subsection, subdivision, paragraph,
27 subparagraph, item, sentence, clause, phrase, or word of this ordinance is declared or to be adjudged
28 to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining
29 portions of the ordinance which shall remain in full force and effect as if the portion so declared or
30 adjudged invalid or unconstitutional was not originally a part of this ordinance.
31 Section 3. Emergency. As a result of the January 21, 1999, tomado, numerous houses are
32 in need of repair. While the repair work is now proceeding at a good pace, the current noise
33 ordinance limits the time frame for construction work to weekdays between the hours of 7:00 a.m.

I and 6:00 p.m. Further, the exception for unusual circumstances cannot last for more than 3b1&'4s.
2 This ordinance permits the Board to declare an area a disaster area, set a time frame for such
3 designation, and permit construction work to last for three additional hours in order to better protect
4 the homes within the area. Such protection and renovation of damaged homes is essential to the
5 public health, safety and welfare. An emergency is, therefore, declared to exist and this ordinance
6 shall be in full force and effect from and after the date of its passage.
