HomeMy WebLinkAbout18064ORDINANCE NO. 0 18,064 'sod AN ORDINANCE ESTABLISHING AN OVERLAY DISTRICT FOR THE CENTRAL CITY REDEVELOPMENT CORRIDOR PURSUANT TO THE DESIGN OVERLAY AUTHORITY OF CHAPTER 36 OF THE CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS; AND DECLARING AN EMERGENCY. WHEREAS, the tornadoes of January 21, 1999, destroyed structures in the Central City Redevelopment Corridor which has generated building permit applications for new construction; and WHEREAS, regulations must be in place to protect the Central City Redevelopment Corridor from the negative impact of poorly planned or incompatible projects; and WHEREAS, very detailed architectural guidelines such as those followed in the MacArthur Park Historic District and the Mansion Area are not warranted in the Central City Redevelopment Corridor, however some architectural guidelines are warranted to ensure that new construction is compatible with the existing structures within the neighborhood; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. Pursuant to Chapter 36 of the Code of Ordinances of the City of Little Rock, a Design Overlay District for the Central City Redevelopment Corridor is hereby established as follows: A. Central City Redevelopment Corridor ( "CCRC") is depicted as Exhibit "A" attached to this ordinance. 2. New Construction. Construction that is characterized by the introduction of new buildings or structures. 3. Block Face. The total of all lots within a city block facing a single given city street. 4. Developed Block Face. A block face containing developed lots which comprise fifty percent (50 %) or more of the block face. 0 D. Review Section The Director of the Department of Planning and Development shall determine compliance of all building permit requests within the boundaries of the CCRC. 503 E. Exceptions Requests for new construction that do not comply with the design regulations of this section as determined by staff may be appealed to the Board of Adjustment pursuant to Article II Division 2 of the Zoning Ordinance. SECTION 2. Severability. This ordinance and its various parts are hereby declared to be severable. If any section, clause, provision or portion of this ordinance is declared invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of this ordinance as a whole. All parts not declared invalid or unconstitutional shall remain in full force and effect. SECTION 3. Emergency. The Board of Directors hereby finds and declares that as a result of the current development pressure in the CCRC following the January 21, 1999 tornadoes, that it is necessary to implement these regulations in order to preserve the existing structures within the affected order to protect and preserve the health, of the citizens of the City, an emergency to exist and this ordinance shall be in upon its passage. Application of Design Regulations The regulations in this ordinance shall be in addition to and shall overlay all other zoning districts and other ordinances requirements regulating the development of land so that any parcel of land lying in the overlay district shall also lie within one or more of the other underlying zoning districts. Therefore, all property within this overlay district will have requirements of both the underlying and overlay- zoning district in addition to other ordinance requirements regulating the development of land. In case of conflicting standards between this ordinance and other City of Little Rock ordinances, the overlay requirements shall control. These regulations apply to all new construction. These regulations shall not apply in areas already protected by the Capitol Zoning District and the MacArthur Park Historic District. Routine repairs, maintenance and interior alterations shall not require compliance with this section. In order to be compatible with the established neighborhood, new construction shall comply with the following criteria. In the case of an undeveloped block face, the requirements shall relate to the adjacent block faces. 1. Roof line. A roof pitch of less than 4:12 shall be prohibited. 2. Materials. The materials of the exterior shell shall be wood, brick or a material that resembles wood. 3. orientation. The orientation shall be consistent with that of other structures on the developed block face. 4. Entrances. The primary entrance shall be consistent with that of other structures on the developed block face. 5. Parking. Parking shall be prohibited in the front yard setback. 6. Non - Residential Setbacks. Non - residential new construction shall be sited at the front property line of the block face. I Mil -11"IMPS lii�l: Roofline. A roof pitch of new structures less than 4:12 shall be prohibited. The roof pitch of drawing 1 is less then 4:12, which is prohibited. The dotted line in drawing I represents a 4:12 pitch, which is permitted. IJ Parking. Parking shall be prohibited in the front yard setback. This restricts parking pads from being placed in a front yard setback, as in drawing 2. On a50 foot by 150 foot lot, the entrance will be on the 50 foot side of the lot facing the street as in drawing 3. Drawing 4 is showing an entrance facing the 150 foot side of the lot, which is prohibited.
