HomeMy WebLinkAbout18061I ORDINANCE NO. 18,061 492 2 3 AN ORDINANCE TO APPROVE A PLANNED ZONING 4 DEVELOPMENT AND TO ESTABLISH A PLANNED 5 DISTRICT -- OFFICE ENTITLED PINNACLE BANK -- PD- 6 O (Z- 5282 -A) LOCATED AT THE NORTHEAST CORNER 7 OF RODNEY PARHAM AND NORTH RODNEY PARHAM 8 ROADS IN THE CITY OF LITTLE ROCK, ARKANSAS; TO 9 AMEND CHAPTER 36 OF THE LITTLE ROCK REVISED 10 CODE OF ORDINANCES; TO RESERVE TO THE BOARD 11 OF DIRECTORS THE RIGHT TO DECIDE WHETHER 12 FINAL FEMA PLANS NEGATIVELY IMPACT 13 ADJOINING PROPERTIES; AND FOR OTHER 14 PURPOSES. 15 Short Title 16 AN ORDINANCE TO APPROVE THE PINNACLE BANK 17 PD-0 (Z- 5282 -A); TO RESERVE TO THE BOARD OF 18 DIRECTORS THE RIGHT TO DETERMINE THE IMPACT 19 OF FEMA PLANS OF ADJOINING PROPERTIES; AND 20 FOR OTHER PURPOSES. 21 22 WHEREAS, the owners of a parcel of land at the northeast comer of Rodney Parham 23 and North Rodney Parham Roads are interested in pursuing a planned development -- office 24 to build a bank building, and 25 WHEREAS, before final approval of this proposal it will be necessary to seek and obtain 26 approval of a floodway plan by the Federal Emergency Management Agency, and 27 WHEREAS, this floodway plan may negatively impact adjoining property owners and 28 the Board of Directors wants to avoid such a negative impact, 29 NOW, THEREFORE, IT BE ORDAINED BY THE BOARD OF DIRECTORS OF 30 THE CITY OF LITTLE ROCK, ARKANSAS: -1- w I Section 1. The zone classification for the following described property shall be 2 changed from R -2, Residential, to PD -O, Planned Development - Office, upon compliance with 3 the provisions of this ordinance. The property description is: 493 4 Part of the SE 1/4 of Section 28, T -2 -N, R -13 -W, Little Rock, 5 Pulaski County, Arkansas, being more particularly described as 6 follows: 7 Starting at the SE corner of the SE '/4 of the SW '/4 of said Section 8 28; thence N 01' 44' 16" West along the East line of said SE '/4 9 SW '/4 a distance of 82.54 feet to the Point of Beginning; thence S 10 86 °O1' 16" West 15.60 feet; thence South 05° 48'44" East 15.00 It feet to a point on the Northerly right -of -way line of Rodney 12 Parham Road (R /W varies); thence along said right -of -way line 13 the following five (5) courses and distances; (1) S 82° 50'09" West 14 77.60 feet; (2) thence N 36° 26' 14" West 59.93 feet (3) thence N 15 10' 29' 51" East 63.67 feet; (4) thence along a curve to the right 16 having a radius of 1,900.00 feet, an arc distance of 98.45 feet and 17 a chord which bears N 12° 08' 12" East 98.44 feet; (5) thence N 18 13° 26' 51" East 152.62 feet; thence S 87° 55' 22" East 68.82 feet 19 to the East line of said SE '/4 SW `/4; thence S 01' 44' 16" West 20 along said East line 327.46 feet to the Point of Beginning 21 containing 0.806 acres or 35,123 square feet. 22 AND 23 Starting at the SE corner of the SE '/4 of the SW 1/4 of said Section 24 28; thence N O1 ° 44' 16" West along the East line of said SE '/4 25 SW '/4 a distance of 410.00 feet to the Point of Beginning; thence 26 N 87° 55' 22" West 68.82 feet to a point on the Easterly right -of- 27 way line of Rodney Parham Road (R /W varies); thence N 13 ° 08' 28 59" East along said right -of -way line 51.553 feet; thence S 87° 18' 29 47" East 58.63 feet, said line being on the South lot line of Lot 1 30 Pleasant Valley Subdivision 1ST INSTALLMENT; thence SO 44' -2- • l 16" West 49.95 feet to the Point of Beginning containing 0.074 2 acres, more or less. 494 3 Section 2. The preliminary site development plan, or plat, as recommended by the 4 Little Rock Planning Commission and attached as Exhibit A is approved. 5 Section 3. The change in the zoning classification contemplated for the Pinnacle 6 Bank PD-0 is conditioned 7 (A) Upon obtaining a final plan approval within the time specified in 8 Section 36- 454(d) of the Little Rock, Arkansas, Revised Code of 9 Ordinances; and 10 (B) Upon a ruling by the Federal Emergency Management Agency 11 that approves the technical details of floodway improvements, provided 12 that these improvements do not negatively impact any neighboring 13 properties, and provided further that the Little Rock Board of Directors 14 reserves the right to determine whether the floodway improvement plan 15 negatively impacts neighboring properties. 16 Section 4.
