HomeMy WebLinkAbout18058NO. 18,058 AN ORDINANCE TO AMEND LITTLE ROCK, ARK., ORDINANCE NO. 17,978 (APRIL 13, 1999) , TO EXTEND THE LIMIT ON EXCAVATION PERMITS, THE PRESERVATION OF TREES, AND THE LIMIT ON DEVELOPMENT ON KANIS ROAD UNTIL SEPTEMBER 30, 1999; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES. • WHEREAS, the City imposed certain development limitations along Kanis Road in Little Rock, Ark., Ordinance No. 17,862 (November 17, 1998), until February 15, 1999, in order to complete a Kanis Road Scenic Overlay, and WHEREAS, the City extended the original ordinance with Little Rock, Ark., Ordinance No. 17,941 (February 16, 1999) (" LRO" ) , from February 15, 1999 to April 2, 1999, and Little Rock, Ark., Ordinance No. 17,978 (April 13, 1999), from April 2, 1999 to June 30, 1999, and WHEREAS, despite attempts to do so, the City is not ready to act on a final plan for this area, but would like to preserve the area as much as possible until all additional planning is complete, and WHEREAS, the temporary limitation period has expired, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. LRO 17,978 is hereby amended to change all dates for the end of the limitations listed in the ordinance from June 30, 1999 or any other date listed, to September 30, 1999. Section 2. Severability. In the event any title, section, subsection, subdivision, paragraph, subparagraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudge to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. 487 Section 3. Emergency. As noted in the previous ordinance, the need to protect this area of Kanis until certain planning tools are in place is essential to preserve the public health, safety and welfare. This extension until June 30, 1999, of the provisions of the earlier ordinance furthers these same objectives. An emergency is, therefore declared to exist and this ordinance shall be in full force and effect from and after the date of its passage.
