HomeMy WebLinkAbout18055ORDINANCE NO. 18,055 AN ORDINANCE APPROVING AMENDED MASTER STREET PLAN FOR THE CITY OF LITTLE ROCK, ARKANSAS, INCLUDING REVISED DESIGN STANDARDS, RELATED MATTERS, AND REPEALING ORDINANCE 15519. M = M 4'76 WHEREAS, the City of Little Rock needs to update comprehensive street design standards to improve growth and function of its street and highway system; and as a framework and guide in further planning and engineering studies; and as a means of enhancing the livability of our community; and WHEREAS, the Little Rock Planning Commission reviewed and conducted public hearings, now recommends adoption of Master Street Plan revision; and WHEREAS, the public health, welfare, and safety of Little Rock citizens will be protected, promoted, and benefited by adoption of this Ordinance. WHEREAS, Subdivision Ordinance requires amendment to delete conflicting requirements. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. Section 2: ROAD CLASSIFICATIONS shall be revised to include a new definition for commercial streets as follows: A. Commercial Street Commercial streets are those boundary streets not identified on the Master Street Plan as a collector, minor arterial, principal arterial, or expressway and property is not used as residential. Residential properties are those properties with single family or two family residences. Residentially zoned property with a permitted use greater than a single or two family residence requires commercial street standards. SECTION 2. The design considerations of the functionally classified street system of the City of Little Rock shall be as follows: A. Expressway Design as designated by Federal Highway Administration and the State Highway Department. Access roads shall be considered commercial streets; however, sidewalk construction is not required with development unless specifically required and approved by the Planning Commission. 0 B. The Planning Commission may approve variance of sidewalk location from street curb and width standards for applications before the Commission. Appeal provisions of these decisions may be filed with the Little Rock Board of Directors. The remaining design criteria waivers and deferrals may be approved by Planning Commission for applications before commission or Director of Public Works for building permit applications, These waivers are limited to 25% variance of standards. Deferrals for improvements are permitted for two years from the date of application or building permit. Appeal provisions of these decisions may be filed with the Little Rock Board of Directors. SECTION 4. If conflicts between this Ordinance and other City Ordinances should occur, the most restrictive Ordinance shall prevail. SECTION 5. That Ordinance No. 15519, adopted August 2, 1988, is hereby repealed, except for the portion not revised herein. SECTION 6. A copy of this Ordinance together with text maps and graphs referred to herein shall be filed in the Office of the Recorder of Pulaski County as required by Act 186 of 1957 of the General Assembly of the State of Arkansas. qq ��j ��}} SECTION 7. If any section, clause, paragraph, provision or portion of this Ordinance oirP4dt� shall be held invalid or unconstitutional, such holdings shall not affect any other section, clause, paragraph, provision or portion of this Ordinance or Plan.
