HomeMy WebLinkAbout180321 ORDINANCE NO.18 , 032 q 2 0 2 3 AN ORDINANCE TO AMEND CHAPTER 31 OF THE CODE OF 4 ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS, TO s PROVIDE FOR A WAIVER OF CERTAIN RIGHT -OF -WAY 6 DEDICATIONS AND STREET IMPROVEMENT REQUIREMENTS FOR 7 THE BLOCK 2 LOFT DEVELOPMENT LOCATED AT THE s SOUTHEAST CORNER OF MAIN AND MARKHAM STREETS; AND 9 FOR OTHER PURPOSES. 10 11 WHEREAS, the Public Works Department has reviewed a proposed development at 12 the southeast comer of Main & Markham streets in the original City of Little Rock, and has 13 determined that this development is not feasible if certain right -of -way dedications are required, 14 and 15 WHEREAS, the waiver of these requirements, if the project as proposed is actually 16 carried out, will not be detrimental to any street plans or other City requirements in the area, 17 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 1E THE CITY OF LITTLE ROCK, ARKANSAS: 19 Section 1. The requirements of Chapter 31 of the Little Rock Revised Code of 20 Ordinances, as amended, which impose certain Subdivision Ordinance and Master Street Plan 21 requirements, are amended in relation to the Block 2 Loft Development as follows: 22 Section 31 -201, requiring right -of -way dedication and boundary 23 street improvements in accordance with the Master Street Plan 24 standards, is waived for the Block 2 Loft Development bounded 25 by Main Street, Scott Street, Markham Street and Second Street, 26 pursuant to the provisions of Section 2 of this ordinance. 27 Section 2. If the developers of the Block 2 Loft Development do not within six 28 months of the date of this ordinance, exercise any and all options that they have on this 29 property, or if they do not develop this property within three years of the date of this ordinance, -1- 1 2 3 4 5 6 7 8 9 10 If 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 then this waiver of boundary street improvements and right -of -way dedication shall automatically be rescinded, null and void.
