AN ORDINANCE TO PROVIDE AN AMENDMENT TO THE
TERMS OF CHAPTER 31 OF THE LITTLE ROCK, ARK.,
CODE OF ORDINANCE TO PROVIDE FOR MASTER
STREET PLAN RIGHT -OF -WAY REQUIREMENTS FOR
LOT 1, BRADY HOME DEMONSTRATION CLUB
ADDITION LOCATED AT 8313 WEST MARKHAM STREET;
AND FOR OTHER PURPOSES.

WHEREAS, the City has been asked to waive right -of -way requirements contained in Little
Rock, Ark., Rev. Code § 31 -282 (1988) which would be triggered by the request for a building
permit to make certain additions to a postal facility at 8313 West Markham Street; and
WHEREAS, the U.S. Postal Service currently leases this space and is not in a position to
dedicate this right -of -way, but wishes to proceed with this project; and
WHEREAS, there currently exists sidewalks in the area and sufficient right -of -way for the
current needs, so the City is willing to make some accommodation to assist this project.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The Board is willing to permit the issuance of necessary building permits for
additions at the U.S. Postal Facility at 8313 West Markham, Little Rock, Arkansas, without a
contemporary dedication of right -of -way as required by Little Rock, Ark., Rev. Code § 31 -282
(1988).
SECTION 2. This accommodation will last until such time as the City needs the dedication
of right -of -way to fulfill the Master Street Plan, provided that if the owner of the property refuses to
dedicate right -of -way at that time, then it will be required at its own expense to remove any and all
improvements or additions made as a result of the building permits issued pursuant to this ordinance.
