CODE § 4-71 (1988) TO PERMIT ESTABLISHMENTS 5 TO SELL ALCOHOLIC BEVERAGES ONE HOUR LATER; 6 TO DECLARE AN EMERGENCY; AND FOR OTHER 7 PURPOSES. 8 9 WHEREAS, the regulations of the Alcoholic Beverage Control Board require 10 businesses which sell alcoholic beverages to close at a certain time if the business is 11 not a private club, and 12 WHEREAS, the City, by ordinance, may extend these hours if it desires to do 13 so, and 14 WHEREAS, the Board of Directors believes that it is important to extend these 15 hours to promote the various hotel, motel and restaurants within the City, 16 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF 17 DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: 18 Section 1. Little Rock, Ark., Rev. Code § 4 -71(a) (1988) is hereby amended to 19 read as follows: 20 Except as otherwise permitted by state law, it shall be 21 unlawful for any person in the City of Little Rock to sell, offer for 22 sale, or give away any alcoholic beverage except as follows: 23 (1) Monday through Friday from 7:00 a.m. to 2:00 a.m. 24 of the following morning; 25 (2) Saturday. from 7:00 a.m. to 1:00 a.m. on the following 26 Sunday morning. 27 Section 2. Seuerability. In the event any title, subtitle, section, subsection, 28 subdivision, paragraph, subparagraph, item, sentence, clause, phrase, or word of this 29 ordinance is declared to adjudged to be invalid or unconstitutional, such declaration -1- • UN 1 2 3 4 5 6 7 8 9 10 11 12 13 14 or adjudication shall not affect the remaining portions of this ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of this ordinance. Section 3. Repealer. All ordinances, resolutions, or regulations, or any parts of such documents, which are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. Section 4. Emergency. The Board of Directors believes that consistency in the enforcement of the sale of alcoholic bevereages in the various hotels, motels and restaurants within the City is essential to the public health, safety and welfare, but that such consistency is not now in place because of different practices and rules. An emergency is, therefore, declared to exist and this ordinance shall be in full force and effect from and after the date of its passage.
