HomeMy WebLinkAbout17941I ORDINANCE NO. 17,941 2 3 AN ORDINANCE TO AMEND LITTLE ROCK, ARK., 73 4 ORDINANCE NO. 17,862 (NOVEMBER 17, 1998), TO o; as s EXTEND THE LIMIT ON EXCAVATION PERMITS, M 6 THE PRESERVATION OF TREES, AND THE LIMIT 7 ON DEVELOPMENT ON KANIS ROAD UNTIL APRIL 8 2, 1999; DECLARING AN EMERGENCY, AND FOR " 9 OTHER PURPOSES. b a 30 WHEREAS, the City imposed certain development limitations along Kanis Road m n in Little Rock, Ark., Ordinance No. 17,682 (November 17, 1998)(`LRO"), until Q 12 February 15, 1999, in order to complete a Kanis Road Scenic Overlay, and rn M 13 WHEREAS, despite attempts to do so, the City is not ready to act on a final plan v 34 for this area, but would like to preserve the area as much as possible until all additional Go 15 planning is complete, and o+ •16 WHEREAS, the temporary limitation period has expired, 17 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS 18 OF THE CITY OF LITTLE ROCK, ARKANSAS: 0 19 Section 1. LRO 17,682 is hereby amended to change all dates for the end of the a. 20 limitations listed in the ordinance from February 15, 1999, or any other date listed, to A 21 April 2, 1999. 22 Section 2. Smerability. In the event any title, section, subsection, subdivision, 0 23 paragraph, subparagraph, item, sentence, clause, phrase, or word of this ordinance is 24 declared or adjudged to be invalid or unconstitutional, such declaration or adjudication 2s shall not affect the remaining portions of the ordinance which shall remain in full force 26 and effect as if the portions so declared or adjudged invalid or unconstitutional was not 27 originally a part of the ordinance. -r- 1 Section 3. Emergency. As noted in the previous ordinance, the need to protect 2 this area of Kanis until certain planning tools are in place is essential to preserve the 3 public health, safety and welfare. This extension until April 2, 1999, of the provisions 4 of the earlier ordinance furthers these same objectives.
