AN ORDINANCE VACATING A PUBLIC UTILITY AND
DRAINAGE EASEMENT ALONG THE PROPERTY LINE
DIVIDING LOTS 1R AND 3R OF JOHN B. MAY'S
ADDITION TO THE CITY OF LITTLE ROCK,
ARKANSAS.
WHEREAS, a petition was duly filed with the Board of
Directors of the City of Little Rock, Arkansas on thel7th day of
December 1998, asking the Board of Directors to vacate all that
portion of the public utility and drainage easement designated on
the plat of John B. May's Addition to the City of Little Rock,
Arkansas, now appearing of record in Plat Book D, Page 249, in
the Office of the Recorder of Pulaski County, Arkansas.
WHEREAS, after due notice as required by law, the Board has,
at the time and place mentioned in the notice, heard all persons
desiring to be heard on the question and has ascertained that the
easement, or portion thereof, hereinbefore described, has
heretofore been dedicated to the public use as a utility and
drainage easement herein described; has not been actually used by
the public generally for a period of at least five (5) years
subsequent to the filing of the plat; that all the owners of the
property abutting upon the portion of the utility and drainage
easement to be vacated have filed with the Board their written
consent to this action; and that public interest and welfare will
not be adversely affected by the vacating of the utility and
drainage easement.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City of Little Rock, Arkansas, releases,
vacates and abandons all its rights, together with the rights of
the public generally, in and to the public utility and drainage
easement designated as follows:
The 10 foot wide easement located along the property
line dividing Lots 1R and 3R (from the east edge of
the utility easement running north -south along the
west property line, to the west edge of the utility
easement running north -south along the east side of
Lot 3R) of John B. May's Addition to the City of
Little Rock, Arkansas.
(Assigned duplicate number in error.)
SECTION 2. A copy of this Ordinance, duly certified by the
City Clerk, shall be filed in the Office of the Recorder of
Pulaski County and recorded in the records of the County.
SECTION 3. This Ordinance shall take effect and be in force
from and after its passage and approval.
