HomeMy WebLinkAbout17930• 1 ORDINANCE NO. 17,930 2 3 AN ORDINANCE TO AUTHORIZE THE CITY 4 MANAGER TO EXECUTE AN AMENDMENT TO THE 55 5 SERVICE APPLICATION FOR ENHANCED 9 -1 -1 6 UNIVERSAL EMERGENCY NUMBER SERVICE 7 AGREEMENT WITH SOUTHWESTERN BELL 8 TELEPHONE COMPANY, TO WAIVE FORMAL 9 BIDDING REQUIREMENTS, DECLARING AN 10 EMERGENCY; AND FOR OTHER PURPOSES. 11 12 WHEREAS, on March 18, 1986, the City Board adopted Resolution No. 13 7,579 agreeing that the funding of a 9 -1 -1 Emergency Telephone Service would be 14 placed before the electors during the General Election in November, 1986; and 15 WHEREAS, on August 27, 1986, the City Board passed Ordinance No. 16 15,155 setting a date for an election to fund the implementation of the 9 -1 -1 17 emergency telephone system and to provide a service charge to finance the 9 -1 -1 18 emergency telephone service system; and 19 WHEREAS, the City placed the 9 -1 -1 issue on the November 1986 ballot 20 and same was approved by the citizens of the City; and 21 WHEREAS, on May 19, 1987, the City Board passed Ordinance No. 22 15,295 establishing and setting a service charge based on a percentage of the basic 23 telephone tariff rate for the implementation and operation of a 9 -1 -1 emergency 24 telephone system; and 25 WHEREAS, the City of Little Rock and Southwestern Bell Telephone 26 Company entered into a Service Application For Enhanced 9 -1 -1 Universal 27 Emergency Number Service Agreement ( "the 9 -1 -1 Service Agreement ") dated May 28 July 11, 1988 whereby Southwestern Bell Telephone Company agreed to furnish 29 the City with Enhanced 9 -1 -1 Universal Emergency Number Service and 30 equipment in accordance with the tariffs filed with the Arkansas Public Service 31 Commission; and 32 WHEREAS, on November 9, 1992, the City executed an amendment to the 33 9 -1 -1 Service Agreement to change the existing AT &T PSAP equipment leased 34 from Southwestern Bell Telephone Company to a the new AT &T Call- Stalker 35 PSAP equipment; and 36 I WHEREAS, the Little Rock Emergency Services Center is in need of 2 certain 9 -1 -1 equipment to be in compliance with FCC regulations and to upgrade 3 outdated equipment; and 4 WHEREAS, it is now necessary to amend the 9 -1 -1 Service Agreement to 5 change the existing AT &T Call Stalker PSAP equipment currently leased from 6 Southwestern Bell Telephone Company to the new PLANT MAARS COM- 7 CENTREX PSAP Equipment and to 8 provide for integrated priority 9 -1 -1 dispatcher stations (10 -60 Button Units) to 9 function with the PLANT MAARS equipment; and 10 WHEREAS, Southwestern Bell Telephone Company has provided 11 maintenance, services, and equipment for the City's 9 -1 -1 system since 1988 and 12 has inventory, maintenance and response personnel capabilities available within 13 minutes for emergency repair due to their proximity to the City's Emergency 14 Services Center; and 15 WHEREAS, the Southwestern Bell Telephone Company integrated priority 16 9 -1 -1 dispatcher stations are specifically designed to work in tandem with the 17 PLANT MAARS COM- CENTREX PSAP equipment and is the only equipment 18 that will function with the PLANT MAARS equipment; and 19 WHEREAS, the Board determines that competitive bidding is not feasible 20 due to the above reasons and therefore waives formal bidding requirements; and 21 WHEREAS, the funding for this Amendment to the 9 -1 -1 Service 22 Agreement is available through the 9 -1 -1 funds account number 250- 214 -1445- 23 4050. 24 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF 25 DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: 26 SECTION 1: The City Manager is hereby authorized to enter into 27 an Amendment to Service Application for Enhanced 9 -1 -1 Universal Emergency 28 Number Service Agreement with Southwestern Bell Telephone Company to provide 29 for the upgrade to the PLANT MAARS COM- CENTREX PSAP equipment at the 30 Little Rock Emergency Services Center for the City's 9 -1 -1 system. This system will 31 consist of a new Southwestern Bell 9 -1 -1 ComCentrex Switch, with integrated 32 priority 9 -1 -1 dispatcher stations (10 -60 Button Units). 33 SECTION 2: The equipment shall be installed by Southwestern Bell 34 Telephone Company on or before June 15, 1999 at a cost of $298,348.00, plus 35 36 -2- 5- r: I applicable taxes, with monthly recurring charges increasing in the amount of 2 $574.10. 3 SECTION 3: The PLANT MAARS COM- CENTREX PSAP equipments}" 4 is compatible with one source of dispatcher station, which is the Southwestern Bell 5 Telephone Company 9 -1 -1 dispatcher station specifically designed to function in 6 tandem with the PLANT MAARS equipment. It is therefore impractical and 7 unfeasible to formally bid in this instance. Accordingly, formal bidding is hereby 8 waived in connection with this 9 -1 -1 system upgrade. 9 SECTION 4: The funding for this Amendment to the 9 -1 -1 Service 10 Agreement is available through the 9 -1 -1 funds account number 250- 214 -1445- 11 4050. 12 SECTION 5: Severability. In the event any section, subsection, 13 subdivision, paragraph, subparagraph, item, sentence, clause, phrase, or word of this 14 ordinance is declared or adjudged to be invalid or unconstitutional, such 15 declaration or adjudication shall not affect 16 the remaining provisions of this ordinance, as if such invalid or unconstitutional 17 provision was not originally a part of this ordinance. 18 SECTION 6: Ernergency. RP TER 34 CITY ATTORNEY 35 36 -3- • 0 AMENDMENT TO SERVICE APPLICATION FOR ENHANCED 9 -1 -1 UNIVERSAL EMERGENCY NUMBER SERVICE EXHIBIT • 58 WHEREAS, there currently exists a contract styled as a Service Application, between Southwestern Bell Telephone Company, a Missouri Corporation, and the CITY OF LITTLE ROCK. Arkansas. The Agreement was signed by the Little Rock City Manager on July 11. 1988; and WHEREAS, the parties thereto wish to amend the same. NOW, THEREFORE, BE IT UNDERSTOOD, that said contract is hereby amended as follows: 1. The purpose for the amendment is to change the existing AT& T CALL STALKER PSAP equipment located at the Little Rock Emergency Services Center to the new PLANT MAARS COM- CENfREX PSAP Equipment. This system will consist of a new Southwestern Bell 9 -1 -1 ComCentrex Switch, With integrated priority 9 -1 -1 dispatcher stations (10 -60 Button Units). 2. Paragraph 3 is amended with the monthly recurring charges increasing in the amount of $574.10. 3. The contract is further amended by adding the following: The equipment shall be installed on or before June 15, 1999. The cost of installation is-122a 348.00 and shall be paid after the installation is complete. Applicable taxes are not included in this cost. 4. The parties agree that all remaining provisions of the original contract including the exhibits and attachments shall remain in full effect, except as expressly modified by this amendment.
