ORDINANCE NO. 17,853
AN ORDINANCE ESTABLISHING THE ST. CHARLES MUNICIPAL
LIGHTING IMPROVEMENT DISTRICT NO. 1 OF LITTLE ROCK,
ARKANSAS; DECLARING AN EMERGENCY; AND FOR OTHER
PURPOSES.

WHEREAS, property owners claiming to be the owners of record title of a majority in value of
the real property located within the territory hereinafter described have filed petitions on October 2,
1998, praying that a municipal improvement district be established pursuant to Ark. Code Ann. Title
14, Chapter 88 for the purposes herein set out; and
WHEREAS, the Board of Directors of the City of Little Rock, Arkansas has authority to create
such a municipal improvement district in that all of the said territory lies completely within the
boundaries of said municipality; and
WHEREAS, the Board of Directors of the City of Little Rock, Arkansas has heard all the
parties desiring to be heard, and has ascertained that said petitions were signed by the owners of a
majority in value of real property within said territory, now, therefore.
IT IS ORDAINED by the Board of Directors of the City of Little Rock, Arkansas:
Section 1. There is hereby established a municipal improvement district embracing the
property in the City of Little Rock, State of Arkansas, described in the attached Exhibit A, to be known
as the "St. Charles Municipal Lighting Improvement District No. 1 of Little Rock, Arkansas" (the
"district "), for the purpose of acquiring, constructing, operating and maintaining a comprehensive system
of street lighting, including, but not limited to, lights, poles, conduit and wiring, underground trenching,
underground gas lines, and the acquisition of easements, rights -of -way and other interests in real property
necessary for the installation of the system either within or without the boundaries of the district; for the
purpose of executing and delivering such contracts and other agreements with such corporate and
governmental entities as are required to acquire, construct and operate such improvements; for the purpose
of maintaining and operating any and all of said improvements; for all purposes authorized by Ark. Code
Ann. Title 14, Chapter 88 and amendments thereto; and to do any and all other acts which shall be deemed
necessary in order to purchase, construct, accept as a gift, operate and maintain any and all improvements
authorized herein.
Said purposes are to be accomplished in the manner and with the materials that the
commissioners for the district shall deem to be in the best interest of the district and as specified by
law. The cost of the project shall be assessed upon the real property of the district according to the
benefits received.
Section 2. Said district shall be known as the "St. Charles Municipal Lighting
Improvement District No. 1 of Little Rock, Arkansas" (the "District'); and Scott Reeves, Allison
Nicholas and Doug Smith, who are the persons nominated in the petition, are hereby named
commissioners and shall compose the Board of Commissioners of the District. The Board of
Commissioners shall also serve as the Board of Assessment of the District. The City Clerk is hereby
authorized and directed to assign a number to the District in accordance with City policies.

Section 3. Said District shall not cease to exist upon the acquiring, construction or
completion of the Project, but shall continue to exist for the purpose of preserving, maintaining and
operating the improvements, all in accordance with Ark. Code Ann. §14 -88 -202.
Section 4, Emergency. It is hereby found and declared that an immediate need exists for
the lighting and other improvements in order to preserve and maintain a safe environment for the
residents of the City. It is, therefore, declared that an emergency exists. This Ordinance, being
necessary for the immediate preservation of the public peace, health and safety, shall take effect and be
in force from and after its passage.
