3 AN ORDINANCE WAIVING COMPETITIVE BIDS AND
4 AUTHORIZING THE CITY MANAGER TO ENTER INTO A
5 SERVICE AGREEMENT WITH MOTOROLA IN THE
6 AMOUNT OF $349,999.64 AS A SOLE SOURCE PROVIDER
7 OF MAINTENANCE FOR THE CITY'S 800 MHZ RADIO
8 SYSTEM.

I0 WHEREAS, Motorola has provided the maintenance for the City's 800 MHZ system for six
11 years; and
12 WHEREAS, the Motorola radio system has proprietary design features that are very
13 important when it comes to considering maintenance; and
I4 WHEREAS, Motorola's proprietary Smartnet Trunking protocal requires unique test
15 equipment capable of decoding and encoding Motorola digital voice privacy secure communications;
16 and
17 WHEREAS, Grace Communications Company of North Little Rock is the only
18 communications company in the central Arkansas area which has the trained personnel, proprietary
19 software and test equipment available contract to properly maintain the City's system and is the
20 service provider for Motorola.
21 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
22 THE CITY OF LITTLE ROCK, ARKANSAS:
23 SECTION 1. The City Manager is authorized to enter into a service agreement with
24 Motorola in the amount of $349,999.64 to provide maintenance on the City's 800 MHZ radio system
25 with the option to extend for five (5) years with pricing, terms and conditions remaining the same
26 for the first, second and third year of the contract. The fourth and fifth years shall be subject to
27 changes due to any consumer price increases.
28 SECTION 2. The City Manager is authorized to waive competitive bidding and
29 declare Motorola as a sole source provider of maintenance forth City's 800 MHZ Radio
30 System in order to ensure proper maintenance of the City's system.

1 SECTION 3. Funding for this project is available from the 911 account.
