ORDINANCE NO. 17,828
AN ORDINANCE APPROVING A CONTRACT BETWEEN THE CITY
OF LITTLE ROCK AND COLLEGE STATION SUBURBAN SEWER
IMPROVEMENT DISTRICT NO. 243 FOR SANITARY SEWER
SERVICE IN THE UNINCORPORATED AREA OF THE COLLEGE
STATION COMMUNITY AND DECLARING AN EMERGENCY.
WHEREAS, the City of Little Rock, Arkansas ( "Little
Rock ") owns a sewage disposal works and operates said works
through the Little Rock Sanitary Sewer Committee ( "the Sewer
Committee ") and the Little Rock Wastewater Utility (the
"Utility ") and the City of Little Rock is authorized to
contract with another city or political subdivision to
provide sewage treatment for that entity to the extent of
the capacity of the sewage disposal works without impairing
the usefulness of said works to the owners upon such terms
and conditions as may be fixed by the Sewer Committee and
approved pursuant to law by the respecting contracting
parties; and
WHEREAS, the College Station Suburban Sewer Improvement
District No. 243 ("SID 24311) proposes to construct a certain
sewage collection system in Pulaski County, Arkansas outside
the current city limits of Little Rock and within the
boundary of SID 243 to be connected to the City of Little
Rock sanitary sewer system since SID 243 does not have the
capability of sewage treatment; and
WHEREAS, it is in the best interest, public health and
welfare of both Little Rock and SID 243 for the extension of
sewer service by Little Rock to SID 243, and the parties

mutually desire now to enter into a contract to enter into
an agreement for the treatment of sewage upon such terms and
conditions as may be fixed by the Sewer Committee and
approved by ordinance of Little Rock and resolution of SID
243; and
WHEREAS, the City of Little Rock and SID 243 desire to
enter into a certain contract pursuant to law for a period
not to exceed 15 years and said contract is attached hereto;
and
WHEREAS, the treatment of sewage in accordance with
said contract will not impair the usefulness of the sewage
disposal works owned by the City of Little Rock, and the
City of Little Rock, by its City Board of Directors, desires
to enter into said contract and authorize the Mayor, City
Clerk, Sewer Committee, and the Manager of the Utility to
execute said contract; -and
WHEREAS, the provisions of A.C.A. §14- 235 -212 require
approval by an ordinance of Little Rock and the equivalent
authority adopted by SID 243, and the Sewer Committee has
recommended approval of the contract for treatment of the
sewage in accordance with the provisions of said contract;
NOW, THEREFORE, BE IT ORDAINED by the Board of
Directors of the City of Little Rock, Arkansas:
f:R[`TTON 1. That the contract between the City of
Little Rock and SID 243 for sanitary sewer service by the
City of Little Rock, for the treatment of sewage from the
College Station unincorporated area of the College Station

community, subject to the charges, collections and all
provisions contained in the applicable Little Rock sewer
ordinances in effect, as well as the ordinance(s) of Pulaski
County, Arkansas, and as amended or changed in the future
during the term of this contract, or any extensions thereof,
is hereby approved. A copy of the contract is on file with
the Clerk of the City of Little Rock, Arkansas and available
for inspection. The Mayor, the City Clerk, the Chairman of
the Sewer Committee and the Manager of the Little Rock
Wastewater Utility are authorized to execute the contract.
4R('TTON 2. That all Resolutions and Ordinances and
parts thereof in conflict with any parts of this ordinance
are hereby repealed.
spcTTON 3. That since the contract approved by this
Ordinance is of great importance to the health and welfare
of the citizens of the City of Little Rock, an emergency is
hereby declared to exist and this ordinance shall be in full
force and effect from and after its passage and approval.
