AN ORDINANCE TO AMEND THE LAND USE PLAN
(16,222) IN THE PINNACLE DISTRICT
FROM SINGLE FAMILY TO OFFICE AND FOR
OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK ARKANSAS.
SECTION 1. That Single Family at the southeast and
northeast corners of the intersection of Chenal Parkway and
Highway 300 be amended to Office.
SECTION 2. That the Land Use Plan be changed from
Single Family to Office on the attached sketch and be
changed in the Land Use Narrative.

AN ORDINANCE TO REPEAL CERTAIN SECTIONS OF
CHAPTER 32 OF THE LITTLE ROCK CITY CODE,
REVISED 1998, WHICH HAVE PARALLEL STATE
STATUTES MATING SUCH CONDUCT UNLAWFUL;
DECLARING AN EMERGENCY; AND FOR OTHER
PURPOSES.
WHEREAS, the City of Little Rock, Arkansas, has several ordinances that make
certain conduct a traffic violation even though there is already a state statute in existence
which covers these same offense; and
WHEREAS, these traffic provisions are being aggressively pursued whether the
individual is charged with an ordinance violation or a state law violation; and
WHEREAS, a major reason for the distinction between charging a person as a
state law violator, or as an ordinance violator, was the impact that such a conviction had
on the local police pension fund, but this distinction is no longer necessary since the
pension fund receives the same amount of money regardless of the nature of the
conviction; and
WHEREAS, the City wishes to remove this list of unnecessary ordinances from
its Code of Ordinances.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City of Little Rock, Arkansas, wishes to repeal all traffic
offenses defined by ordinance if there is a parallel state statute that makes the conduct
illegal.
SECTION 2. (a) Section 32 -3 of the Little Rock City Code, Revised 1988,
adopts by reference all provisions of Title 27 of the Ark. Code Ann. that do not
constitute a felony, Ark. Code Ann. § 27 -1 -101 - 27 -53 -405.
(b) Section 32 -3 of the Little Rock City Code, Revised 1988, is repealed.
SECTION 3. (a) Section 32 -4 of the Little Rock City Code, Revised 1988, has
• parallel state statute, Ark. Code Ann. § 27 -49 -111.
(b) Section 32 -4 of the Little Rock City Code, Revised 1988, is repealed.
SECTION 4. (a) Section 32 -5 of the Little Rock City Code, Revised 1988, has
• parallel state statute, Ark. Code Ann. § 27 -49 -108.

12 SECTION 56. SEVERABILITY. In the event any section, subsection,
13 subdivision, paragraph, subparagraph, item, sentence, clause, phrase, or word of this
14 ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
15 adjudication shall not affect the remaining portions of this ordinance which shall remain
16 in full force and effect as if the portion so declared or adjudged invalid or
17 unconstitutional was not originally a part of this ordinance.
18 SECTION 57. EMERGENCY. It is hereby found and determined by the Board
19 of Directors of the City of Little Rock that no need exists to have certain traffic
20 ordinances in effect which parallel existing state statutes, and that repeal of said
21 ordinances will result in the more effective and efficient administration of justice in the
22 City. To assure that this consistent and effective administration occurs as soon as
23 possible, and yet provide sufficient time to the Little Rock Police Department to make
24 the transition, an emergency is hereby declared to exist, and this Ordinance, being
25 necessary for the preservation of the public peace, health and safety, shall be in full force
26 and effect from and after December 15, 1998.
