The City Manager is authorized to enter into an agreement with the 4 Pulaski Enterprise Community Alliance for an amount not to exceed hundred thirty -one 5 thousand dollars ($131,000) in a form substantially the same as that attached as Exhibit 6 A to this Ordinance. 7 SECTION 2. Little Rock, Ark. Res. No. 10,208 (February 24, 1998), is hereby 6 repealed. 9 SECTION 3. Emergency Clause. R— E— C- 1— T —A —L —S WHEREAS, PECA has entered into an agreement with the U.S. Department of Housing & Urban Development, the State of Arkansas, the City, North Little Rock, and Pulaski County, pursuant to Title Xlll, Subchapter C, Part l of the Omnibus Budget Reconciliation Act of 1993 (28 U.S.C. §§ 1391, of seg), to assist in certain areas of economic development, and WHEREAS, PECA is able to provide bonding and technical support to small businesses that will enable these businesses to become competitive for the award, through a competitive bidding process, of City contracts, and WHEREAS, the City believes that it is in its best interests to enter into such an agreement and, thereby, to increase the pool of contractors available to compete for City business, and WHEREAS, PECA and the City wish to contract for the provision of certain services, NOW, IN CONSIDERATION OF THE COVENANTS AND AGREEMENTS SET FORTH BELOW, THE PARTIES AGREE AS FOLLOWS. 1. Term This Agreement shall be in effect from and after the date of its execution, until February 28, 1999. This Agreement may be extended for up to four additional one year terms, provided that the first extension shall automatically expire on December 31, 1999, and provided, further, that the City Board of Directors must adopt a resolution authorizing such extension prior to December 31 of the year before the extension. Consideration q addition to other good and validoRnsideration set forth Within this Agreement, the City agrees to pay a sum, not to exceed one hundred and thirty one thousand dollars (x"131,000.00) to PECA for the services set forth in this Agreement to be accomplished during the initial term of this Agreement. If this Agreement is extended, the parties shall negotiate an additional consideration to cover the services to be provided during the extended term. 3. Services to be pi °ovided In consideration of the monies set forth in Section 2, PECA agrees to provide the following services to the City: (A) To identify contractors with sales that do not exceed one hundred thousand dollars annually (x100,000.00), but which are able to become qualified to bid on construction contracts within the City if the company is certified as eligible to receive an appropriate construction bond; (B) To establish a clearing house to identify small, minority and women business enterprises and contractors -- for purposes of this Agreement, .small, business enterprises are those with sales more than one hundred thousand dollars (x100,000.00) annually, but less than five million dollars (x5,000,000.00) annually; (c) To establish collaborative efforts with existing contractors for public and private partnerships to the extent permitted by Arkansas law; (D) To assist in improving the business climate for small businesses within the City and, to assist in developing a long term plan to leverage and sustain public dollars available to assist small businesses in order to achieve the maximum benefit for such businesses; EXHIBIT A Page 2 of 4 186 1 2 3 4 � 5 6 a 9 10 11 12 13 14 15 16 1T 16 19 20 21 22 23 24 25 M ! M M M M M ® M _ ® M M (E) To helpncrease construction opportunitieoor both PECA and city residents, (F) To assist in developing an expanded pool of small businesses, including minority and women owned businesses, by helping these businesses to obtain necessary bonding capacities in order to compete for City contracts and meet state statutory bonding requirements in order to qualify as a responsible and responsive bidder, (G) To serve additional contractors within the City limits that are not already included within the PECA boundaries existing on the date this Agreement is executed; (H) To expand training for small businesses and contractors with particular emphasis on the process to qualify for bonding. (1) To achieve the goals as outlined on Exhibit A to this contract. 4. Pilot program. This Agreement sets forth the terms and conditions for a pilot program to see if the City can achieve its interest in expanding the number of small businesses eligible to compete for City contracts through the training and technical support offered by PECA to such businesses. 5. lhondiserimmalron Except for the size parameters set forth above, PECA shall not discriminate against any person, partnership, corporation or business on the basis of race, sex, creed, national origin or disability. Nothing within this provision limits the ability of PECA to legitimately set the size of any training classes and, upon that size being reached upon a .first come first served,. basis, to close the 26 class. 27 6. The City agrees thaIPECA may use Pulaski( 2 County, to the extent required by PECA, as its fiscal agent for purposes of carrying 3 out the terms of this Agreement. A letter from Pulaski County agreeing to serve as 4 fiscal agent is attached to this Agreement as Attachment A. s 7. Amendments in writing There shall be no amendment to the terms of 6 this Agreement unless executed in writing by the City and PECA and attached as an 7 addendum to this Agreement. a B. Contact. Since Pulaski County is the fiscal agent for SHERWOOD the Pulaski Enterprise Community Alliance ("PECA "), 1 understand that the City would like to coordinate its efforts with PECA for bonding and technical support for small WRIGHTSVILLE businesses. Pulaski County hereby agrees, as the fiscal agent for PECA , to handle a sum of up to One Hundred and Thirty -One Thousand Dollars ($131,000), to be paid by the City to provide bonding and technical support to small businesses. Based upon previous correspondence, Pulaski County has been apprised that, for purposes of the PECA agreement, a small business is one that has sales in the range of One Hundred UNINCORPORATED Thousand ($100,000) to Five Million ($5,000,000) Dollars, but can include businesses AREA with sales less than One Hundred Thousand ($100,000) Dollars that PECA believes can BOO SOUARE MILES exceed that amount with proper bonding and technical support.
