HomeMy WebLinkAbout17600ORDINANCE NO. 17,600 AN ORDINANCE VACATING AND CLOSING THE STREETS IN MAUMELLE ORCHARD ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS. WHEREAS, a Petition was duly filed with the Little Rock City Clerk on the25th day of September, 1997, asking the Little Rock Board of Directors to vacate and abandon the streets in Maumelle Orchard Addition to the City of Little Rock, Arkansas, as designated on the plat of said Addition now appearing of record in Plat Book 1, Page 211, in the office of the Recorder of Pulaski County, Arkansas; and WHEREAS, after due notice as required by law, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the rights -of -way herembefore described have been dedicated to the public use as streets, have not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat, or for at least five (5) years prior to the filing of the Petition; that the sole owner of the property abutting upon the streets to be vacated has filed with the City Clerk its written consent to the abandonment, by signing the Petition; and WHEREAS, the public interest and welfare will not be adversely affected by the abandonment of the streets. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the streets designated as follows: The platted road leading from Arkansas State Highway #10, South from the Northeast corner of Tract 41 of said Addition to the Southeast corner of Tract 60 of said Addition; thence West tot the Southwest corner of Tract 58 of said Addition; and The platted road beginning at the Southeast corner of Tract 58 of said Addition, extending South to the Southeast corner of Tract 99 of said Addition SECTION 2. Petitioner, as the sole abutting owner of record, receiving title to the abandoned right -of -way and easement, shall at its cost remove all vestiges of public use and access as may exist. SECTION 3. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the Office of the Recorder of Pulaski County and recorded in the records of the County. f:V�.+rc4orkYW Wucx.oN r■ r r r r r� r r� r r� r r r SECTION 4.
