3 AN ORDINANCE TO AMEND CHAPTER 31 OF THE
4 LITTLE ROCK, ARK., CODE OF ORDINANCES (1988)
5 TO ACCEPT THE DEDICATION OF CERTAIN
6 RIGHT -OF -WAY IN LIEU OF BOUNDARY STREET
7 IMPROVEMENTS FOR LOTS 1, 2, A -1 and A -2 OF THE
8 BRISTOW SUBDIVISION; TO DECLARE THE INTENT
9 TO SEEK SUCH IMPROVEMENTS IN THE EVENT OF
10 A MORE INTENSIVE USE OR ZONING THAN SINGLE
1 I FAMILY RESIDENTIAL; AND FOR OTHER PURPOSES.

13 WHEREAS, the City has before it a request for a total waiver of boundary street
14 improvements for Lots 1, 2, A -1 and A -Z. of the Bristow Subdivision; and
15 WHEREAS, the unique circumstances of this situation make it more appropriate to
16 accept certain right -of -way dedication to arterial street standards in lieu of these boundary
17 street improvements; and
18 WHEREAS, the Board further states its intent to require such boundary street
19 improvements in the future should the use of any of these lots become significantly more
20 intensive or require a more intensive zoning classification.
21 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
22 OF THE CITY OF LITTLE ROCK, ARKANSAS:
23 SECTION 1. The Board accepts a dedication of right -of -way to minor arterial street
24 standards for lots 1, A -1 and A -2, in lieu of a requirement of boundary street improvements
25 set forth in Little Rock, Ark., Rev. Code § 31- 201(1988), as amended, for Lots 1, 2, A -1 and
26 A -2 of the Bristow Subdivision, so long as the properties in Lots A -1 and A -2 are not used
27 for a more intensive use than single family residential, and so long as the zoning

I classifications for Lots I!* A -I and A -2 are not changed a more intense zoning
2 classification.
3 SECTION 2. The Board declares its intent to seek boundary street improvements in
4 the future for Lots 1, 2, A -1 and A -2 of the Bristow Subdivision should a more intensive use
5 than single family residential be in place for lots A- I and A -2, or should an amendment to
6 permit a more intense zoning classification than that in place on the effective date of this
7 ordinance for Lots 1, 2, A -1 and A -2 of the Bristow Subdivision be granted.
8 SEC'T'ION 3. The Board notes the unique situation surrounding this particular action
9 which includes, but is not limited to, a prior waiver of certain boundary street improvements
10 for Lots I and 2 of Bristow Subdivision; the change in classification from collector street to
11 minor arterial street for Cooper Orbit Road; and, the willingness of the applicant to provide
12 right of way dedication to the City for Lot 1 despite the fact the applicant no longer owns
13 such property.
14 SECTION 4. This ordinance is not passed with an emergency clause and shall not
15 be in full force and effect until 30 days from the date of its passage.

AN ORDINANCE AMENDING ORDINANCE NO.
17,189 AND PROVIDING FOR AN AMENDED USE
LISTING FOR TRAMMELL SHORT -FORM PCD AT
5323 BASELINE ROAD (Z- 4855 -C) IN THE CITY
OF LITTLE ROCK, ARKANSAS, AMENDING
CHAPTER 36 OF THE CODE OF ORDINANCES OF
THE CITY OF LITTLE ROCK, AND FOR OTHER
PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That the approved use listing for Trammell
Short -Form PCD established by Ordinance No. 17,189 be
amended for purposes of including "Beauty Shop /Hair Salon"
as an authorized use, on property described as:
A parcel of land in part of Tract 8, Sparks Acres
Subdivision to the City of Little Rock, Arkansas,
at 5323 Baseline Road being more particularly
described as follows:
A part of Tract 8, Sparks Acres Subdivision to the
City of Little Rock, Pulaski County, Arkansas;
more particularly described as: The North 315.0
feet of the East 105.0 feet of Tract 8, Sparks
Acres Subdivision to the City of Little Rock,
Pulaski County, Arkansas containing 0.75 acres
more or less.
SECTION 2. That the preliminary site development
plan /plat be approved as recommended by the Little Rock
Planning Commission.
SECTION 3. That the change in use listing contemplated
is conditioned upon obtaining a final plan approval within
the time specified by Chapter 36, Article VII, Section 36-
454(d) of the Code of Ordinances.
SECTION 4. That this ORDINANCE shall take effect and
be in full force upon final approval of the plan.
