3 AN ORDINANCE ABANDONING AND CLOSING
4 PORTIONS OF NORTH VALENTINE STREET NORTH
5 OF THE "P, STREET INTERSECTION; ALSO
6 PORTIONS OF "I" STREET EAST OF ITS
7 INTERSECTION WITH VALENTINE STREET;
g RETAINING EASEMENTS; AND FOR OTHER
9 PURPOSES.

11 WHEREAS, a petition was duly filed with the Little Rock City Clerk asking the Little
12 Rock Board of Directors to vacate and abandon portions of Valentine Street and "P' Street
13 legally described below; and
14 WHEREAS, after due notice as required by law, the Board of Directors has, at the
15 time and place mentioned in the notice, heard all persons desiring to be heard on the question
16 and has ascertained that the portions of street right -of -way described herein have been platted
17 and dedicated to the public; that the portion of Valentine Street to be closed has never been
18 constructed and used as a street right -of -way; that the portion of "I" Street to be closed has
19 been used by the public for street right -of -way and utility easements within the last five years,
20 however, the reservation of utility and drainage easements in the former rights -of -way
21 adequately preserves the rights of easement holders therein and the public generally; that all
22 but one of the owners of the property abutting upon the portions of right -of -way to be vacated
23 have filed their written consent to the closure; and
24 WHEREAS, the public interest and welfare will not be adversely affected by the
25 abandonment of these rights -of -way.
26 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
27 OF THE CITY OF LITTLE ROCK, ARKANSAS:
28 SECTION 1. The City of Little Rock, Arkansas hereby releases, vacates and
29 abandons all of its rights, together with the rights of the public generally, in and to the street
30 rights -of -way designated as follows:
31 North Valentine Street

That portion of North Valentine Street right -of -way lying West of
33 and adjacent to the West 1/3 of Lots 7, 8 and 9, Block 6, East Pulaski
34 Heights Addition to the City of Little Rock, Pulaski County,
35 Arkansas, more particularly described as follows

Beginning at the Southwest corner of Lot 7, Block 6; thence North
along the West line of Lots 7, 8 and 9 150.0 feet to the Northwest
corner of Lot 9; thence West 25.0 feet to the centerline of North
Valentine Street; thence South along the centerline of N. Valentine
Street 140.0 feet; thence East 22.0 feet; thence South 20.5 feet; thence
East 3.0 feet; thence North 10.5 feet to the point of beginning.
"I" Street
That portion of "P' Street right -of -way being 10.5 feet in width lying
South of and adjacent to the West 1/3 of Lot 7, Block 6, East Pulaski
Heights Addition to the City of Little Rock, Pulaski County,
Arkansas.
The above - described right -of -way is found in Plat Book 76 at page
452 in the office of the Recorder of Pulaski County, Arkansas.
SECTION 2. The City specifically retains the right to use, and allow others to use,

the
existing easements as follows:
I. Valentine Street
a. Twenty (20) foot existing Arkansas Power and Light Co. easement.
b. Ten (10) foot Little Rock Wastewater easement being five (5) feet
either side of existing sewer main.
2. "I" Street
a. Fifteen (15) foot Little Rock Waterworks easement being 7.5 feet
either side of existing water main.
SECTION 3. The abutting owners of record receiving title to the abandoned street
rights -of -way shall, at their cost, remove all vestiges of public use and access as may exist.
SECTION 4. A copy of this Ordinance, duly certified by the City Clerk, shall be
filed in the Office of the Recorder of Pulaski County, Arkansas and recorded in the real estate
records of Pulaski County.
SECTION 5. This Ordinance shall take effect and be in force from and after its
passage and approval.
