3 AN ORDINANCE RECLASSIFYING PARTS OF PLOTS
J, K AND L, WOODLAND HEIGHTS SUBDIVISION,
4 LITTLE ROCK, ARKANSAS TO 0-3 WITH
5 CONDITIONS, AMENDING CHAPTER 36 OF THE
6 CODE OF ORDINANCES OF THE CITY OF LITTLE
ROCK, ARKANSAS; AND FOR OTHER PURPOSES.

8 WHEREAS, on July 17, 1996 the Little Rock Board of Directors denied a request to
9 rezone approximately 8 acres in Woodland Heights Subdivision to 0-3 General Office
10 classification, file No. Z -6106; and
1 I WHEREAS, the owners of the subject property appealed the decision to Pulaski
12 County Chancery Court where the case is now pending styled as James L. Rush, et al. v. City
13 of Little Rock No. OT96 -5594; and
14 WHEREAS, in an effort to settle the case, the current owners of the property have
15 requested that the Court allow them to bring the rezoning request back before the Little Rock
16 Board of Directors to consider the application to rezone the property to 0-3 with conditions;
17 and
18 WHEREAS, the conditions which the owners are requesting to be attached to the 0-3
19 request are those which were agreed to by the neighbors in the first hearing when the owners
20 did not agree to condition the application on the concerns of the adjacent property owners; and
21 WHEREAS, pursuant to its lawful authority, the Little Rock Board of Directors has
22 allowed the owners to bring the matter directly to the Board without first presenting the
23 request to the Planning Commission because the Commission had approved the conditions in
24 its previous hearing on this request.
25 NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
26 OF THE CITY OF LITTLE ROCK, ARKANSAS.
27 SECTION 1. That the zone classification of the following property be and is hereby
28 changed from R -2 Single Family to 0-3 General Office (Woodland Heights Road
29 approximately 330 feet south of Summit Road):
30 Part of Plots J, K, and L, Woodland Heights Subdivision Little Rock, Arkansas, More
31 Particularly Described as:

33 Commencing at the Northeast Comer of Plot L; Thence S 02 °00'49"
W along the East line of said plot L 225.11' to the point of beginning;
34 thence continue along the East line of said plot L S 02 °40'13" W
35 341.60' to the SE corner of Plot L; thence N 87 °24'14" W along the
36 South line of said plot L 346.28' to the Southwest corner thereof,
I thence S 87 °40'36" W along the South line of plot K 337.88' to the SW 575
2 corner thereof, thence S 68 °58'24" W 51.37; thence N 43 °25'29" W
42.10; thence N 86 041155" W 63.70' to a point on the West line of East
3 %z of Plot J; thence N 01 °48'01" E 276.23'; thence S 87 °06'59" E

9 SECTION 2. That the 0-3 zoning shall be subject to the following conditions
10 proposed by the applicant which shall be covenants running with the land to bind subsequent
11 grantees of the property.

13 * A building height restriction of no more than two (2) stories;
14 * Maximum lot coverage of 25%
15 * The following uses shall not be permitted:

17 A. College dormitory
18 B. College fraternity or sorority
19 C. Establishment for care of alcoholic, narcotic or psychiatric patients
20 D. Mortuary or funeral home
21 E. Bar, lounge or tavern
22 F. Beverage shop
23 G. Drugstore or pharmacy
24 H. Eating place with drive -in service
25 I. Ambulance service post
26 J. Cemetery or mausoleum
27 K. High -rise multifamily, at a density greater than thirty (30) units per
28 gross acre
29 L. Hotel or motel
30 M. Abortion clinic
31 N. Adult bookstore
32 O. Adult video store

34 SECTION 3. That the map referred to in Section 36 of the Code Ordinances of the
35 City of Little Rock and designated district map be and is hereby amended to the extent and in

I the respects necessary to affect and designate the change provided for in Section 1 and 2
2 hereof.
3 SECTION 4. That the Ordinance shall take effect and be in full force from and after 576
4 its passage and approval.
