ORDINANCE NO. 17,555
AN ORDINANCE DISPENSING WITH COMPETITIVE
BIDDING; AUTHORIZING THE CITY MANAGER TO
ENTER INTO A CONTRACT WITH ARKANSAS
ACORN FAIR HOUSING ORGANIZATION FOR THE
CDBG FAIR HOUSING PROGRAM; AND FOR OTHER
PURPOSES.
WHEREAS, the City of Little Rock is badly in need of a Fair Housing Program;
WHEREAS, the Arkansas ACORN Fair Housing Organization, which has counseled
over 100 families to become homeowners in the past year, is the only full service Fair
Housing Organization in Pulaski County; and
WHEREAS, the Citizen Consolidated Planning Committee, as well as the Oak
Forest and Woodruff CDBG Community, has selected the Arkansas ACORN Fair Housing
Organization as the most qualified to do the Little Rock CDBG Fair Housing Program for
the fiscal year 1996; and
WHEREAS, the Arkansas ACORN Fair Housing Organization uniquely has come
up with more than $250,000 in matching funds for the program which is to be implemented.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City Manager is authorized to enter into a contract with Arkansas
ACORN Fair Housing Organization, the low bidder meeting specifications, in an amount
not to exceed $50,500, for the CDBG Fair Housing Program.

SECTION 2. Notwithstanding Section 1 above, any contract entered pursuant to
this ordinance shall require that any names obtained through the housing counseling process
shall be shared with the City including, but not limited to, the City Land Bank Authority.

Dear Mr. Nickerson:
�j On the night of August 19, 1997, during the City's weekly broadcasting of
�j its public hearings, we noted that the City's Board of Directors voted to suspend
the "Rule for Competitive Negotiation" for the purpose of awarding $50,500 in
Federal monies to ACORN Fair Housing. As you know, the awarding of Federal
monies must be administered under Regulatory Requirements for Procurement,
which are set forth at 24 CFR Part 85.36.
Because the City's method of procurement for this service, i.e., Housing
Counseling, which is to be provided by ACORN's Fair Housing, did not meet the
requirements for procurement as set forth at 24 CFR Part 85.36, we are herein
directing the City not to award any Federal monies to any agency under such
conditions. Further, we can your attention to 24 CFR Part 85.36(d)(4)(C), which
states that the authorization of noncompetitive proposals can only be executed by
the "Awarding Agency," in this case, the U.S. Department of Housing and Urban
Development (HUD). Accordingly, the expenditure of Federal monies without
following Procurement Procedures will be considered "Ineligible" and,
subsequently, be recaptured by HUD.
