As you know, the awarding of Federal monies must be administered under Regulatory Requirements for Procurement, which are set forth at 24 CFR Part 85.36. Because the City's method of procurement for this service, i.e., Housing Counseling, which is to be provided by ACORN's Fair Housing, did not meet the requirements for procurement as set forth at 24 CFR Part 85.36, we are herein directing the City not to award any Federal monies to any agency under such conditions. Further, we can your attention to 24 CFR Part 85.36(d)(4)(C), which states that the authorization of noncompetitive proposals can only be executed by the "Awarding Agency," in this case, the U.S. Department of Housing and Urban Development (HUD). Accordingly, the expenditure of Federal monies without following Procurement Procedures will be considered "Ineligible" and, subsequently, be recaptured by HUD.
