HomeMy WebLinkAbout17490ORDINANCE NO. 17,490 M M _ ii AN ORDINANCE VACATING AND CLOSING A PORTION OF CHENAL PARKWAY RIGHT -OF -WAY AND BRISTOL DRIVE BETWEEN CHENAL PARKWAY AND AUTUMN ROAD, PARTIALLY LOCATED IN MONTCLAIR HEIGHTS SUBDIVISION (PART 11), AN ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS, PURSUANT TO THE ARKANSAS CODE ANNOTATED SECTION 14 -54 -104 (MICHIE 1987). 370 WHEREAS, a petition was duly filed with the Little Rock City Clerk on the 18th day of April , 1997, asking the Little Rock Board of Directors to vacate and abandon a portion of Chenal Parkway right -of -way and Bristol Drive between Chenal Parkway and Autumn Road, partially located in Montclair Heights Subdivision (Part II), an Addition to the City of Little Rock, Arkansas, as designated on the plat of said Addition now appearing of record in Plat Book 6, Page 25, and in a Dedication Deed shown recorded in Deed Record Book 644, Page 285, and in a Warranty Deed recorded as Instrument No. 88- 32021, all in the office of the Circuit Clerk of Pulaski County, Arkansas; and WHEREAS, after due notice as required by law, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the rights- cf -vmy hereinbefore described, have been dedicated to the public use as a street, have never been used by the public as a street, subsequent to the filing of the plat and other dedication instruments; that all owners of the property abutting upon the portion of the street to be vacated have filed with the City Clerk their written consent to the abandonment; and WHEREAS, the public interest and welfare will not be adversely affected by the abandonment of the street. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas, pursuant to the authority of Arkansas Code Annotated Section 14- 54-104 (Michie 1987), hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the street designated as follows: RIGHT -OF -WAY ABANDONMENT DESCRIPTION A part of the South 1/2 of the North 112 of the Northeast 1/4 of the Southwest 1/4 of Section 4, T -1 -N, R -13 -W, a part of the Right -of -Way for Bristol Drive and a part of the Right -of -Way of Chenal Parkway, all in the City of Little Rock, Pulaski County, Arkansas being more particularly described as follows: Commencing at the Northeast Comer of the Northeast 1/4 of the Southwest 1%4 of said Section 4; thence S 00036'55" E, 19.63 feet; thence N 89 023'22" W, 20.00 feet; thence S 00033'07" E, 325.36 feet; thence N 89 023'37" W, 14.19 feet; thence S 00033'07" E, 325.22 feet; thence N 89'31'49"W, 289.69 feet for the POINT OF BEGINNING. Thence N 89 031'49" W, 25.00 feet; thence S 00 021'31" E, 18.02 feet to the South line of Bristol Drive Right-of-Way; thence N 89 031'49" W, 25.01 feet; thence N 89 031'49" W, along said South Right -of -Way 250.79 feet to the Northedy Right -of -Way of Chenal Parkway; thence along said Northerly Right -of -Way of Chenal Parkway along a curve to the left having a radius of 1165.92 feet and an arc length of 129.11 feet with a chord bearing and distance of N 66 °43'39" W, 129.04 feet; thence N 00 °23'47" W, along the Right -of -Way of Chenal Parkway, 40.00 feet; thence continue along said Right -of -Way of Chenal Parkway S 61 °19'42" E, 84.63 feet to the North Right -of -Way of Bristol Drive; thence along said North Right -of -Way of Bristol Drive S 89 °31'49" E, 345.05 feet; T•7i')ifR�Ia thence S 00 021'31" E, 32.00 feet to the POINT OF BEGINNING. Containing 0.433 acres (18,875 Sq. Ft.) more or less. SECTION 2. Abutting owners of record, receiving title to the abandoned right-of-way 3171 and easement shall at their cost remove all vestiges of public use and access as may exist; such modifications shall include, but are not limited to the following: A. The entrances on both ends of the abandoned right -of -way and easement shall be offset and /or rebuilt to conform to the standard driveway design as required by Little Rock, Ark. Rev. Code Sec. 30 -26 -50 (1988). B. The edge of pavement of the right -of -way shall be rebuilt to conform to existing conditions in the general vicinity where the abandoned right -of -way and easement intersects with the remaining public right -of -way. SECTION 3. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the Office of the Recorder of Pulaski County and recorded in the records of the County. SECTION 4. This Ordinance shall take effect and be in force from and after its passage and approval.
