HomeMy WebLinkAbout17400ORDINANCE NO. 17,400 AN ORDINANCE ESTABLISHING HEATHERBRAE PROPERTY OWNERS' MUNICIPAL IMPROVEMENT DISTRICT NO. 5 OF LITTLE ROCK, ARKANSAS; NAMING THE COMMISSIONERS TO THE BOARD OF IMPROVEMENT; AND DECLARING AN EMERGENCY Whereas, parties claiming to be all of the owners of record title as reflected by the deed records in the office of the circuit clerk and ex officio recorder of Pulaski County, Arkansas, of real property located within the territory hereinafter described, filed their petition on January 28, 1997, with the Little Rock City Clerk praying that an improvement district be established for the purposes hereinafter set out; and, Whereas, the petition being one for the formation of a property owners' improvement district and having received certification from Beach Abstract & Guaranty Company that the subscribers to the petition constitute all of the owners of record title of the real property located within the territory hereinafter described, no further notice is required pursuant to law; and NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. There is hereby established the Heatherbrae Property Owners' Municipal Improvement District No. 5 of Little Rock, Arkansas, which embraces the following real property in the City of Little Rock, County of Pulaski, State of Arkansas, to wit: Part of the E1 /2, NE1 /4, Section 24, Township 2 North, Range 14 West, City of Little Rock, Pulaski County, Arkansas, more particularly described as follows: Beginning at the SW comer, E1 /2, NEIA, NEIA, Section 24, Township 2 North, Range 14 West; thence S 02 0741" W for a distance of 540.67 feet; thence N 87 3714" E for a distance of 219.34 feet; thence N 18 29'43" E for a distance of 81.61 feet; thence N 54 57'13" E for a distance of 114.70 feet; thence N 4124'08" W for a distance of 76.21 feet; thence N 22 5 P] 0" E for a distance of 115.26 feet to a point of the South R/W line of Glenn Valley; thence N 66 2739" W along the chord of a curve to the left for a distance of 58.28 feet; thence N 15 41'41" E for a distance of 203.42 feet; thence S 89 05'52" W for a distance of 19.0 feet; thence N 01 37'28" E for a distance of 751.32 feet; thence N 83 25'34" W for a distance of 299.49 feet; thence S O1 43'43" W for a distance of 781.20 feet to the Point of Beginning. And 163 M M Lots 18, 19, 20, 21, 22, & 23 of Heatherbrae Subdivision Phase 2 to the City of Little Rock, Pulaski County, Arkansas. for the purposes of purchasing, accepting as a gift, constructing, or maintaining facilities for drainage, waterworks, recreation, gas pipelines, underground trenches and excavations necessary for the installation by public utilities or municipal utilities of electric and telephone distribution systems, sanitary sewers, streets and highways, including curbs and gutters, and sidewalks, together with facilities related to any of the foregoing, to serve the inhabitants of the district and constructing such areas and improvements beyond the boundaries of the district, if necessary, to cause the improvements within the district to obtain their desired effect. Section 2. The above purposes are to be accomplished in the manner and of the materials that the commissioners of the district shall deem to be in the best interest of the district. Section 3. The cost of the project shall be assessed upon the real property of the district according to the benefits received. Section 4. Jack D. Wilson, Ronnie Shrader and George E. Collins, Jr., who are either the owners or the legal representatives of the owners of real property within the district, are hereby named and confirmed as commissioners of, and shall compose the board of improvement of, the district. Section 5. The formation of the district and the improvements planned thereby are essential to the continued health, safety, growth and well being of persons within the City of Little Rock and the formation of the district and the purposes of the district can be accomplished only by the passage of this ordinance. Therefore, an emergency is declared to exist and this ordinance, being necessary for the preservation of the public peace, health and safety, shall be in force upon its passage and approval.
