HomeMy WebLinkAbout17356-s 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 ORDINANCE NO. 17,356 836 AN ORDINANCE TO DECLARE THE INTENT OF THE BOARD OF DIRECTORS TO AMEND THE CITY ZONING ORDINANCES TO INCLUDE A PROPER DEFINITION FOR CORRECTIONAL FACILITIES WHICH INCLUDES, AMONG OTHER THINGS, HALFWAY HOUSES; DECLARING A MORATORIUM ON THE GRANTING OF BUILDING PERMITS OR ZONING REQUESTS FOR SUCH FACILITIES; AND FOR OTHER PURPOSES. WHEREAS, as a result of recent events it has become clear that at present any property zoned 0-3, General Office, is available for use as a halfway house or other such correctional facility; and WHEREAS, this use has been deemed a permitted use for the classification of charitable institutions; and WHEREAS, the Board of Directors has determined that such a permitted use is not appropriate since it does not guarantee appropriate neighborhood or community input; and WHEREAS, the Board of Directors has also learned that appropriate agencies of the federal government will not enforce notice provisions to assure such input, hence it is incumbent upon the City to take even more protective measures of the rights and interests of its citizens. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The Board of Directors declares that from the date of this ordinance until the adoption of an appropriate ordinance, a period not to exceed ninety (90) days, no building permits shall be allowed for any correctional facilities or halfway houses that are presently deemed appropriate as a matter of right in 0-3, General Office, zoning. SECTION 2. The Board of Directors declares that there is no appropriate zoning classification for correctional facilities or halfway houses within the City, and that none shall exist until the present zoning ordinances are amended to denote any such use as a conditional use. The Board of Directors states its understanding that two ordinances have been prepared which address this issue and, that a public hearing is presently set for December 19, 1996, before the Little Rock Planning Commission to consider the terms of such an ordinance. Since this Board will soon have an ordinance for consideration, no permits or rezonings for any purpose associated with correctional facilities shall be allowed until such an ordinance has become effective, or for a period of ninety (90) days from the date of this resolution, whichever comes first.
