AN ORDINANCE RELEASING A RESERVATION OF
4 PUBLIC RIGHT TO USE ABANDONED
5 RIGHT -OF -WAY OF NORTH FILIXORE STREET FOR
6 DRAINAGE AND UTILITY PURPOSES.

8 WHEREAS, On March 25, 1957 the Little Rock Board of
Directors passed LRO No. 10,478 which vacated and abandoned
9 all rights of the City and the public generally to use a
10 portion of North Fillmore Street between Michigan Avenue and
11 Scenic Drive for street right -of -way; and _
12 WHEREAS, Section 1 of the ordinance released, vacated
and abandoned the rights of the public except for the
13 requirements of public utilities, specifically Little Rock
14 Municipal Water Works, for ingress and egress to maintain the
15 utility lines, and reserved unto the City any rights it may
16 have for ingress and egress to control drainage in the area;
17 and
WHEREAS, the owner of Lot 12R Block 7 Park View Replat
18 to the City of Little Rock, which is adjacent to the vacated
19 and abandoned right -of -way, has proposed to build a single
20 family structure on Lot 12R; and
21 WHEREAS, the owner has requested that the City release
22 its rights which were reserved in LRO 10,478 in the West half
of the former right -of -way; and
23 WHEREAS, Water Works states that it has no need to use
24 the former right -of -way for utility purposes, and the City
25 has determined that it has no present or future need to
26 reserve the drainage rights in the West half of the abandoned
27 right -of -way.
NOW, THEREFORE, BE IT RESOLVED BY THE LITTLE ROCK BOARD
28 OF DIRECTORS, OF THE CITY OF LITTLE ROCK, ARKANSAS:
29 SECTION 1. The City of Little Rock hereby releases all
30 right it may have to use the West half of abandoned North
31 Fillmore Street between Michigan Avenue and Scenic Drive,
32 intersecting Blocks 7 and 8 of Park View Addition, Plat Book
1, Page 142, and partial replat in Deed Record Book 507, page
33 410, in the office of the Recorder of Pulaski County,
34 Arkansas.

SECTION 2. The City reserves unto itself the right to
use the East half of the former right -of -way abandoned in LRO
No. 10,478 for utility and drainage purposes, and the North 7
fifteen (15) feet of the West half of the abandoned
right -of -way for utility and drainage purposes.
SECTION 3. A copy of this ordinance duly certified by
the City Clerk shall be filed in the office of the recorder
of the county and recorded in the deed records of the county.
SECTION 4. This ordinance shall take effect and shall be
in force and effect from and after its passage.
