3 AN ORDINANCE DISPENSING WITH THE
4 REQUIREMENT OF COMPETITIVE BIDDING
AND AUTHORIZING THE CITY MANAGER TO
5 ENTER INTO A CONTRACT WITH THE
6 ARKANSAS EMERGENCY PHYSICIANS'
7 FOUNDATION TO PROVIDE MEDICAL
8 OVERSIGHT AND QUALITY CONTROL FOR
9 THE METROPOLITAN EMERGENCY MEDICAL
SERVICES AND THE LITTLE ROCK FIRE
10 DEPARTMENT FIRST RESPONDERS,
11 DECLARING AN .EMERGENCY; AND FOR
12 OTHER PURPOSES.

WHEREAS, the the Board of Directors may dispense with the
14 requirement of competitive bidding in exceptional situations
15 where such procedure is not feasible; and
16 WHEREAS, the Board finds that an exceptional situation
17 exists in the case of the provision of medical oversight and
18 quality control for the Metropolitan Emergency Medical Services
19 ("MEMS ") and the Little Rock Fire Department First Responders
(Fire Rescue) to justify dispensing with competitive bidding;
20 and
21 WHEREAS, the exceptional situation involves factors such as
22 1) the Arkansas Emergency Physicians' Foundation ("AEPF") is the
23 only organization composed of emergency physicians from every
hospital in MEMS' service area; 2) the President of AEPF has
24 authorized MEMS to use his narcotics license number to equip
25 MEMS ambulances with drugs necessary to treat the
26 life - threatening conditions encountered by MEMS' paramedics;
27 and 3) the long -term interest expressed by AEPF in MEMS delivery
28 of high - quality ambulance service for the City.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
29 THE CITY OF LITTLE ROCK, ARKANSAS:
30 SECTION 1. The Board of Directors of the City of Little
31 Rock finds that competitive bidding should be waived for the
32 purpose of contracting with AEPF for the independent medical
33 oversight of MEMS and Little Rock Fire Department First
Responder services, as an exceptional situation exists and
34 competitive bidding is not feasible.
35 SECTION 2. The City Manager is hereby authorized to enter
36 into a yearly contract with the Arkansas Emergency Physicians'

Foundation, automatically renewable. on the anniversary date
thereof, to provide independent medical oversight of MEMS and
Little Rock Fire Department First Responder services in an
amount not to exceed $36,000 per year.
SECTION 3. Emergency. It is hereby found and determined
that the services performed by the AEPF are essential to the
peace, health, and safety of the citizens of this City; and
that there exists an urgent need for the AEPF to begin medical
oversight of the Fire Department's First Responder services,
continue medical oversight of MEMS, and assist the coordination
of emergency medical care delivery between the two entities.
Therefore, an emergency is hereby declared to exist and this
Ordinance being necessary for the preservation of the public
peace, health and safety shall be in full force and effect from
and after its passage and approval.
