HomeMy WebLinkAbout17169ORDINANCE NO. 17,169 AN ORDINANCE VACATING A PORTION OF THE PUBLIC UTILITY EASEMENT IN BLOCK 174 OF THE ORIGINAL CITY OF LITTLE ROCK, ARKANSAS. WHEREAS, a petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas on the 12th day of March, 1996, asking the Board of Directors to vacate a portion of the public utility easement designated on the plat of Block 174, Original City of Little Rock, Arkansas. (Note: The plat of said Block 174, Original City of Little Rock does not appear of record in the office of the Recorder of Pulaski County, Arkansas.) WHEREAS, after due notice as required by law, the Board has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the easement, or portion thereof, hereinbefore described, has heretofore been dedicated to the public use as a utility easement herein described; has not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat; that all the owners of the property abutting upon the portion of the utility easement to be vacated have filed with the Board their written consent to this action; and that public interest and welfare will not be adversely affected by the vacating of the utility easement. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas, releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the utility easement designated as follows: The east 7' of the east one half of former alley in Block 174, Original City of Little Rock, Arkansas, beginning at a point 4' north of the south boundary of Lot lo, extending 1461, plus or minus, north to the right -of -way of Nest 9th Street. (This portion of the utility easement was retained in ordinance No. 14,868, which closed the alley.) SECTION 2. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the Office of the Recorder of Pulaski County and recorded in the records of the County. MM M �■ ! s lb M SECTION 3.
