HomeMy WebLinkAbout17131� s 147 ORDINANCE NO. 17.131 1 2 AN ORDINANCE TO REPEAL LIT'T`LE ROCK, 3 ARK., ORDINANCE NO. 16,382 (MARCH 4 13, 1993) CONCERNING THE MUNICIPAL JUDGES RETIREMENT PLAN; DECLARING 5 AN EMERGENCY, AND FOR OTHER 6 PURPOSES. 7 8 WHEREAS, the Board adopted an ordinance that would have 9 permitted an amount of credit for prior public service as a quorum court member and a law enforcement officer for persons 10 serving as a municipal judge; and 11 WHEREAS, it has become apparent that the state implementing 12 statute does not apply to the retirement plan for municipal 13 judges and, therefore, this ordinance has no legal effect; and 14 WHEREAS, repeal of this ordinance is necessary to overcome any confusion on this issue; and 15 SEAS, the Board remains committed to the principle that 16 prior public service should be entitled to some credit towards 17 vesting in municipal retirement plans and, as a result, wishes 18 to seek appropriate and general enabling legislation that will recognize such service as time spent as a prosecuting attorney, 19 a city attorney, a member of the military, a law enforcement 20 officer, a member of the quorum court, and other similar public 21 professions recognized by the General Assembly in the past. 22 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 23 THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. Little Rock, Ark., Ordinance No. 16,382 (March 24 13, 1993) is hereby repealed. 25 SECTION 2. EMERGENCY. Public employee retirement plans are 26 one part of various compensation packages that help assure that 27 the City public health, safety and welfare is protected and 28 served competent and dedicated persons. Any question about the application of a particular retirement package can create 29 confusion that diverts attention from the numerous tasks that 30 need to be dealt with on a daily basis by municipal employees. 31 In the case of the municipal judges retirement plan, the 32 ordinance being repealed by this ordinance creates such 33 confusion.
