ORDINANCE NO. 17.131

AN ORDINANCE TO REPEAL LIT'T`LE ROCK,
ARK., ORDINANCE NO. 16,382 (MARCH
13, 1993) CONCERNING THE MUNICIPAL
JUDGES RETIREMENT PLAN; DECLARING
AN EMERGENCY, AND FOR OTHER
PURPOSES.

WHEREAS, the Board adopted an ordinance that would have
permitted an amount of credit for prior public service as a
quorum court member and a law enforcement officer for persons
serving as a municipal judge; and
WHEREAS, it has become apparent that the state implementing
statute does not apply to the retirement plan for municipal
judges and, therefore, this ordinance has no legal effect; and
WHEREAS, repeal of this ordinance is necessary to overcome
any confusion on this issue; and
SEAS, the Board remains committed to the principle that
prior public service should be entitled to some credit towards
vesting in municipal retirement plans and, as a result, wishes
to seek appropriate and general enabling legislation that will
recognize such service as time spent as a prosecuting attorney,
a city attorney, a member of the military, a law enforcement
officer, a member of the quorum court, and other similar public
professions recognized by the General Assembly in the past.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. Little Rock, Ark., Ordinance No. 16,382 (March
13, 1993) is hereby repealed.
SECTION 2. EMERGENCY. Public employee retirement plans are
one part of various compensation packages that help assure that
the City public health, safety and welfare is protected and
served competent and dedicated persons. Any question about the
application of a particular retirement package can create
confusion that diverts attention from the numerous tasks that
need to be dealt with on a daily basis by municipal employees.
In the case of the municipal judges retirement plan, the
ordinance being repealed by this ordinance creates such
confusion. In order to minimize this confusion, and to assure
the legal status of the pension plan, an emergency is declared
to exist and this ordinance shall be in full force and effect
from and after the date of its adoption.
