3 AN ORDINANCE TO AMEND LITTLE ROCK,
4 ARK. REV. CODE § 12 -28 (1988) TO
5 EXCEPT JOB QUALIFICATION
6 REQUIREMENTS; DECLARING AN
EMERGENCY AND FOR OTHER PURPOSES.
7 WHEREAS, Little Rock, Ark. Rev. Code § 12 -28 (1988)
8 incorporated by reference the Arkansas Fire Prevention Code,
9 Volume 1, 1992 Edition (1991 Standard Fire Prevention Code with
10 Arkansas Amendments) and the Arkansas Fire Prevention Code,
11 Volume 2, 1992 Edition (1991 Standard Building Code with
Arkansas Amendments and 1992 SBCCI Amendment to Section 1206
12 °Earthquake Loads "); and
13 WHEREAS, among its many provisions, the Arkansas Fire
14 Prevention Code establishes job qualification requirements for
15 certain positions; and,
WHEREAS, the job qualification requirements stated in the
16 Arkansas Fire Prevention Code conflict with those already
17 established by the City.
IS NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
19 THE CITY OF LITTLE ROCK, ARKANSAS:
20 SECTION 1. Section 28 of Chapter 12 of the Little Rock,
Ark. Rev. Code (1988) is hereby amended to read as follows:
21 (a) The following publications are adopted by
22 reference:
23 (1) Arkansas Fire Prevention Code, Volume 1, 1992
24 Edition (1991 Standard Fire Prevention Code with
25 Arkansas Amendments).
(2) Arkansas Fire Prevention Code, Volume 2, 1992
26 Edition (1991 Standard Building Code with Arkansas
27 Amendments and 1992 SBCCI Amendment to Section 1206
28 "Earthquake Loads ").
29 (b) In the event of a conflict between the
30 publications in subsection (a), the more stringent
provisions shall govern.
31 (c) Notwithstanding the provisions of sections
32 (a) and (b) above, the City, consistent with other
33 provisions of state law, shall set the job
34 qualifications of its employees. No job qualifications
35 contained in the Arkansas Fire Prevention Code are
adopted in any form whatsoever.

SECTION 2. SEVERABIISTY. The sections of this ordinance
shall be severable. In the event any section of this ordinance
is found by a court of competent jurisdiction to be
unconstitutional, the remaining sections of this ordinance are
valid, unless the court finds the valid sections are so
essentially and inseparably connected with and so dependent upon
the void section that it cannot be presumed that the Board of
Directors would have enacted the valid sections standing alone;
or unless the court finds that the valid sections, standing
alone, are incomplete and are incapable of being executed in
accordance with the legislative intent.
SECTION 3. EMERGENCY CLAUSE. It is essential that job
qualifications be clearly established to prevent the authority
of persons holding those positions from being called into
question. This ordinance.is hereby declared to be an emergency
measure and shall become effective immediately upon passage and
approval by the Board of Directors.
