5 AN ORDINANCE TO AUTHORIZE THE CITY MANAGER TO
6 ENTER INTO A CONTRACT WITH AMERICAN
7 MANAGEMENT SYSTEMS, INC., TO PROVIDE COMPUTER
8 SOFTWARE SUPPORT; TO DISPENSE WITH
9 COMPETITIVE BIDDING; DECLARING AN EMERGENCY;
AND FOR OTHER PURPOSES.

11 WHEREAS, the City has previously purchased a computer
12 system to use for the daily operations and functions of
13 government including, but not limited to, payroll, personnel,
14 police and fire records, and other information; and
WHEREAS, American Management Systems, Inc., prepared the
15 original software for this system and is uniquely qualified to
16 provide maintenance support for this system; and
17 WHEREAS,. the current maintenance agreement has expired and
18 it is time to renew the agreement,
19 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
20 Section 1. The City Manager is authorized to enter into an
21 agreement for a period of one year, with an option to renew for
22 not more than two consecutive one year terms, with American
23 Management Systems, Inc., to provide computer maintenance
service in an amount not to exceed sixty one thousand one
24 hundred and seventy -five dollars ($61,175.00).
25 Section 2. Because of the unique familiarity that American
26 Management Systems, Inc. has with the City's computer system, it
27 is impractical and unfeasible to bid this contract and,
28 therefore, the requirement for competitive bidding is hereby
waived.
29 Section 3. Funds for this contract are found in Account No.
30 113 - 1350 -4123.
31 Section 4. Emergency. The ability to maintain the City
32 computer system in order to deal with everything from traffic
33 control to payroll records is essential to the public health,
34 safety and welfare. It is also necessary to have an active
contract with a computer maintenance firm to deal- with any
35 emergencies that may occur should the computer system
36 malfunction. An emergency is, therefore, declared to exist and
