ORDINANCE NO. 17,035
AN ORDINANCE AMENDING CHAPTER 18
SECTIONS 18- 52(2)(3) OF LITTLE ROCK,
ARK. REVISED CODE (1988), DECLARING
AN EKERGENCY; AND FOR OTHER
PURPOSES.
WHEREAS, changes in technology require an amendment to the
City's Noise Ordinance to assure that all audio equipment, such
as CD- players and portable stereos, are included in the
definitions of prohibited activities.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. That S 18- 52(b)(2) and (3) entitled 'Noises
prohibited generally" shall be amended as follows:
(2) The playing of any radio, phonograph, any type of
audio equipment, or any musical instrument in
such a manner or with such volume, particularly
to annoy or disturb the quietness, or comfort or
peace of any persons in or around an office,
hospital, or in any dwelling, hotel or other type
of residence.
(3) Any group yelling, hooting, shouting out or the
playing of any type of audio equipment on the
public streets, at any time or place, in such a
manner as to annoy or disturb the quiet, comfort
or peace of persons in any hospital, dwelling,
hotel or other type of residence or otherwise
creates an annoyance or problem..
2. EMERGENCY. It is hereby found and determined by the
Board of Directors of the City that there is an immediate need
to require an amendment to the City's Noise Ordinance to protect
the health, safety and welfare of the City and its inhabitants.
Therefore, an emergency is declared to exist, and this Ordinance
being necessary for the preservation of the public peace,
health, welfare and safety shall be in force and take effect
from and after its passage and approval.
