5 AN ORDINANCE TO DESIGNATE PROMOTER
6 AND BOOKING AGENT SERVICES FOR
7 RIVERFRONT AMPHITHEATER EVENTS AS A
8 PROFESSIONAL SERVICE, PURSUANT TO
9 AUTHORITY GRANTED IN ACT 429 OF 1995
AND LITTLE ROCK, ARK..ORDINANCE NO.

13 WHEREAS, Act 429 of 1995 was effective February 24, 1995,
14 and
WHEREAS, such Act expands the scope'of Ark. Code Ann.
15 §19 -11 -801 et seq. regarding the selection of professional
16 services, and
17 WHEREAS, Act 429 authorizes a political subdivision to
18 include as professional services such consulting services as the
political subdivision shall designate by two - thirds vote of its
19 governing body, and
20 WHEREAS, Section 1 (a)(3) of Little.Rock, Ark. Ordinance
21 No. 16, 982 (October 3, 1995) authorizes the Board to declare a
22 service a professional service if cost or price bidding is found
23 to be impractical, unfeasible, or if based solely on price.,
would result in an outcome that would not meet the best
24 interests of the City,.and
25 WHEREAS, a low bid contract would not be able to provide
26 the City with a diverse mix of entertainment to appeal to a wide
27 number of demographic groups of concertgoers, and
28 WHEREAS, a promoter and booking agent with a proven track
record is crucial to the success of Riverfront Amphitheater
29 concerts, and
30 WHEREAS, the company or individual selected must be able to
31 provide a minimum of twelve (12) high quality (top of the line)
32 acts per year, and
33 WHEREAS, based upon the above recitals, the Board of
Directors finds that price or cost bidding for the provision of
34 promoter and Booking Agent services for Riverfront Amphitheater
35 events is impractical, unfeasible, or, if based solely on price,
36 would result in an outcome that would not meet the best

interests of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The provision of Promoter and Booking Agent for
River front Amphitheater event services is hereby declared a
professional service. Such professional services shall be
contracted for a maximum five (5) year term pursuant to the
professional services laws of this State, Ark. Code Ann.
§19 -11 -801 - §19 -11 -805, as amended, or Act 616 of 1989, as
amended.
SECTION 2. The City Manager is hereby authorized to issue
and publish Requests for Qualifications for Promoter and Booking
Agent services for Riverfront Amphitheater events.
SECTION 3. Final award of said.contract will be made by the
Board of Directors after consideration of the City Manager's
recommendation made pursuant to City selection procedures.
