Home My WebLink About167439 ORDINANCE NO. 16,743 0 AN ORDINANCE ABANDONING CERTAIN EASEMENTS AND NARROWING THE WIDTH AND ABANDONING AND CLOSING THAT PORTION OF THE ALLEY ADJACENT TO LOTS 2, 3, 4, 5 AND 22 IN BLOCK 1, MCGEHEE ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS, PURSUANT TO ARK. CODE ANN. SEC. 14 -54 -104 (MICHIE 1987). WHEREAS, a petition was duly filed with the Little Rock City Clerk on the 1st day of June, 1994, asking the Little Rock Board of Directors to vacate and abandon a portion of the alley adjacent to Lots 2, 3, 4, 5 and 22, Block 1, McGehee Addition to the City of Little Rock, Arkansas, as designated on the plat of said Addition now appearing of record in Plat Book 2, Page 78, in the office of the Recorder of Pulaski County, Arkansas; and WHEREAS, after due notice as required by law, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question; has ascertained that the alley hereinbefore described has been dedicated to the public use as an alley and that the portion of the alley to be vacated is no longer needed for corporate purposes; and WHEREAS, the public interest and welfare will not be adversely affected by the narrowing of the alley. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. Except as stated in Section 2 below, the City of Little Rock, Arkansas, pursuant to authority of Ark. Code Ann. Sec. 14 -54 -104 (Michie 1987), hereby releases, vacates and abandons all its rights, together with the rights of the public 430 i generally, in and to that portion of the alley designated as follows: ALLEY CLOSING -EAST SIDE A portion of a 20 ft. alley lying West of and adjacent to Lots 2, 3, 4 and 5, Block 1, McGehee Addition to the City of Little Rock, Arkansas, more particularly described as: Beginning at the Southwest corner of said Lot 2, Block 1; thence S89 °00'17 "W, 3.18 ft.; thence North, 8.3 ft.; thence Northwesterly along the arc of a 100.42 ft. radius curve to the left having a chord bearing and distance of N36 °32' 18 "W, 118.82 ft.; thence N19° 16'37 "E, 1.54 ft. to the Northwest corner of Lot 5, said Block 1; thence Southeasterly along the Westerly lines of Lots 5, 4, 3 & 2, said Block 1, being the arc of a 103.0 ft. radius curve to the right, having a chord bearing and distance of S37 °09' 19 "E. 121.55 ft. to a point on the Westerly line of said Lot 2; thence South along said Westerly line, 8.3 ft. to the point of beginning (Tract "A "). ALLEY CLOSING -WEST SIDE A portion of a 20 ft. alley lying East of and adjacent to Lot 22, block 1, McGehee Addition to the City of Little Rock, Arkansas, more particularly described as: Starting at the Southeast corner of said Lot 22, Block 1; thence North along the Easterly line of said Lot 22, Block 1, 58.3 ft. to the point of beginning; thence Northwesterly along said Easterly line, being the arc of a 83.0 ft. radius curve to the left, having a chord bearing and distance of N34° 15'26 "W, 91.04 ft. to the Northerly most corner of said Lot 22, Block 1; thence N00 °59'11 "W, 9.07 ft.; thence Southeasterly along the arc of a 90.42 ft. radius curve to the right, having a chord bearing and distance of S34 °39'47 "E, 102.37 ft.; thence S89 000'17 "W, 6.82 ft. to the point of beginning (Tract "B "). SECTION 2. The City specifically retains the right to use, and allow others to use, the former alley right -of -way in its entirety as a public utility and drainage easement, except for the following described portion of Tract "B ", upon which all utility easements and rights of the public shall be abandoned: A tract East of and adjacent to part of Lot 22, Block 1, McGehee Addition to the City of Little Rock, Arkansas, more particularly described as: Starting at the Northwest most corner of said Lot 22, Block 1; thence S00 °59'11 "E along the West line of said Lot 22, Block 1, 6.42 ft.; thence N87 °19'58" E, 11.47 ft. to a point on the Easterly line of said Lot 22, Block 1, said point being the point of beginning; thence N87° 19'58 "E, 11.28 ft.; thence S49 001'26 "E, 21.20 ft.; thence S23 °50'31 "E, 16.09 ft.; thence S19 °25'43 "E, 22.87 ft. then S11'18'13"E, 11.43 ft.; thence S83 °28'53 "W, 4.50 ft. to a point on the Easterly line of said Lot 22, 0 0 Block 1; thence Northerly along said Easterly line, being the arc of a 83 ft. radius 4 3 02 curve to the left, having a chord bearing and distance of N32 °32'09 "W, 72.81 ft. to the point of beginning (Tract "C "). Notwithstanding the foregoing, Little Rock Wastewater Utility shall retain an easement over Tracts "A" and "B ". SECTION 3. Abutting owners of record, receiving title to the abandoned right- of -way and easement shall at their cost remove all vestiges of public use and access as may exist. SECTION 4. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the Office of the Recorder of Pulaski County and recorded in the records of the County. SECTION 5.
